Hey, VJ friends!

I need your advice/help. On Saturday we found this notice in our email:

Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

Current Status: Notice Returned as Undeliverable.

On August 14, 2009, the post office returned the notice we last sent you on this case I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS as undeliverable. This may have serious effects on processing this case. Please call 1-800-375-5283 to update your mailing address for this notice to be re-sent.

When we filed for my K-1, my fiance at that time lived in VA. When I came here, we moved to Indiana. I changed the address online, by calling them and mailing the AR11. All of those things.

At the end of July we filed for I485, I131 and I765. We got a notice of receipt, for all three of them at our new address.. And then we got this message about I485 and I765. I think it was a notice to schedule my biometrics appointment. I called the number today and got two service requests. I read a lot of cases on this website that those people at the call center only send notices to USCIS and those notices get lost and the best thing to do is to schedule an infopass with our local USCIS office. Do you think we should do that?

I am really worried and need your help.

Thank you in advance.

If it were me, and if the InfoPass location was relatively convenient, I'd make an appointment in the next coming days - if the service requests don't show results (or the notices don't show up in the mail, which I've seen happen).

It is curious that you got the original NOA1's but didn't get the (probably) biometrics notice. Do you have your spouse's name inside your mailbox?

No, I don't think we have my spouse's name inside our mailbox.

I think we'll schedule the infopass appointment for as soon as it 's available.

Thank you,

Marina

I had exactly the same problem & did as the above says to try to resolve it. One problem I found was the childs name wasnt inside the mail box.

At Info Pass meeting I was told it would take a least 60 days to forward these documents. I recieved them the next day.

I really hope that will be our case. We'll make sure to put our names on the mailbox today! Thanks for the advice.

Hey, guys!

I just scheduled an appointment for this coming Thursday. I have a few questions to you though.

1. I put 1 person since I was the one filing for the form. Is it okay if my husband, USC, will come along with me?

2. What do I bring with me? I am thinking: passport, with I-94 (not valid anymore though), my Ukrainian driver's license, our 3 notices of receipts for I485, I765 and I131. Print out of that message :undeliverable notice. NOA 2 for my k-1 approval. ANything else? Or and my husband will have his driver's license together with his US passport.

What do you think?

Yes he can go. He needs I D .

You just need I D as well. Bring anything that has your USCIS info on it. They wil use that to pull up your case & review it on the computer. They will tell you your mail was returned & can check your address that shows in the system.

It seems the address was correct because you got the notice. The problem is prbably just what mine was; no name in the box. Check with your P O to make sure the entire family can recieve mail at the address. Include any possible names.

we had an infopass appt and changed our address there in May. I also went online and did the AR 11, we received written confirmation in May that they had the new address. Come July when the mailed the RFE it was to the old address. We did a service request with our new address and they resent the RFE along with a copy of an AR 11 to us. The address label on this one was so smeared you could only read part of the last name, the street name (not the house number) and part of the city.

Their computers are either on separate systems and only update like once every x months or they may print the address labels as they get the case and not bother to check for an address change when they mail something.

Don't sweat it, not a big deal.

It is a big deal if they dont get the letters or any information USCIS sends, especially if its biometric appointment notice.

When we did not get the biometric notice it set my daughters case back months & caused a lot of additional work to get back on track.

We had a similar problem - we changed our address right away when we moved but apparently it didn't take. We ended up with an RFE and even though we got an e-mail the day they sent it out and immediately called to make sure it was going to the right address it took them over 3 weeks to fix the problem and we didn't get the notice until yesterday, 3 days before it was due back with the requested evidence in CA. An additional source of frustration is that they are claiming our medical docs were not sufficient based on what is apparently someone else's app, referencing a doctor we have never heard of and an appointment with him that was obviously not ours, as it was nearly 3 months after we filed our application!!!

Unfortunately, nothing is no big deal with these cases - they can reject you on a whim because of their own mistakes and when they do so there seems to be no recourse other than starting the process from scratch with all the money, stress and wasted time repeating itself...
