Hi All,

We married on 08/08/2009 in Vietnam. I just got back to the States and fill out Form I-130 and supporting documents. I have all other supporting documents except for evidences of a bona fide marriage. Since we just got marry, we do not have any documents listed items "E thru I" from USCIS. Since we just got marry Vietnam, we don't have affidavits sworn by third parties in the US.

What other relevant documents that I could use to establish that there is an ongoing marital union?

The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bona fide marriage. One or more of the following is acceptable documents:

E. Documentation showing joint ownership or property; or

F. A lease showing joint tenancy of a common residence; or

G. Documentation showing co-mingling of financial resources; or

H. Birth certificate(s) of child(ren) born to you, the petitioner, and your spouse together; or

I. Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship. (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage); or

J. Any other relevant documentation to establish that there is an ongoing marital union

Just a copy of your marriage certifficate and a english translation (by certified translator in US) of your marriage license . you dont need anything else

08/05/2009: interview-get blue slip request timeline

08/25/2009: submit timeline - get denial blue slip

Just a copy of your marriage certifficate and a english translation (by certified translator in US) of your marriage license . you dont need anything else

• Attachment: stating mailing and physical addresses of both the petitioner and beneficiary

• Form I-130, Petition for Alien Relative

• Form G-325A, petitioner’s Biographic Information with photo of petitioner

• Form G-325A, beneficiary’s Biographic Information with photo of beneficiary

• A copy of petitioner’s naturalization certificate of citizenship

• A copy of petitioner’s non-expired US passport

• Certified copy of marriage certificate with English translation

• Copy of marriage certificate (Vietnamese)

• A copy of beneficiary’s Vietnam passport with English translation

• A copy of beneficiary’s birth certificate with English translation

Evidence of the bona fides of the marital relationship - NONE

I agree Kevin.. he needs prrof of relationship..pictures of wedding Dam Hoi etc... the more that is front loaded the better... affidavits from others about the relationship also... why wait until the interview to prove the relationship...

We did have both engagement cerermony (Dam Hoi) on 08/01/2009 and Wedding ceremony (Dam Cuoi) on 8/08/2009. The engagement and wedding ceremony are within a week. My question is that should I submit the pictures from the engagement and wedding ceremony with the I-130 package and also our timeline of relationship?

I really appriciate your you inputs and advices for this complicated processes.

Yep!

Front load as much as you can. Buy a quick life insurance policy. Make out a will. Load them with captioned pictures. Open a ITF bank account.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Since we just recently got marry, none of my friends and relatives in the US know my wife personally. That is the resean why I don't have any affidavits about our relationship.

I have friends and relatives that met my fiance through Yahoo IM and WC... They have seen and talked to her and can make an affidavit based on what they have seen... everything helps... A bona fide relationship is one that a "reasonable person" would consider a real relationship... IMO friends and relatives are 'reasonable'

Yep!

Also change all the beneficiaries on your 401(k), IRAs, ect over to your wife.

OP, only one month from engagement to marriage? If I were you, I would provide lots of "extra" evidence BEFORE the interview (in your submitted paperwork with the USCIS).

Just remember, life over there in VN is NOT real! Your money will be worth a LOT less once you get back over here. Back to reality, cowboy!

I agree with DauQue, you should submit evidence, and the most important evidence is the one before marriage.

Having a Dam Hoi and Dam Cuoi that close together is odd. Many Vietnamese people have the Dam Hoi and Dam Cuoi on the same day, which is normal. Having it a week apart really sticks out.

My opinion about evidence of relationship or evidence of marriage is that the consulate officers have a job to do. If they were to pass people without having enough documents, then they personally could potentially get into professional or even legal trouble. Therefore, make their job easier and less stressful by giving enough documentation that makes your case at least passable.
