Timeline

I have a friend who emailed me ,..after interview was given a 221g. I have researched it ,but I am still confused . He told me the case has been sent back to usa where application was sent from. Does this mean they are in review? Or does this mean that a final decision has been made not to approve the visa ? I have read other comments on timelines ,,waiting security checks. Did they also receive a 221g, or is that different ? BTW this is Morocco embassy .

Well...well. Morocco just doesn't quit. First, I am curious as to what type of visa this was for. Second...was it a woman CO? Reason being this has just happened to me and my fiance in Morocco. Oh...and there are more of us...many more. You can hop on over to the ME/NA forum and learn alot about this subject.

I can tell you this:

The 221g with a statement of the file being sent back to the Unites States is not a hard denial. It means the petition is being sent back to the original service center who processed it...for review.

The petitioner will receive notification from the USCIS service center who processed their petition. Now, this process will take up to 6 months if not longer for the petitioner to actually receive notice of their intent.

The USCIS will review the case...they can decide to uphold the CO not being able to prove the relationship or decide to re-process the case and send it back to Casablanca for another interview. In the first scenario, the petitioner will have an opportunity to rebut the findings...whatever they are. The kicker here is that they will have 30 days from the date of the letter from the USCIS to do so.

Honestly, I do not know real statistics on how many of these petitions which are sent back for review actually make it back to the consulate for issuing a visa...some do, but many do not.

As for my petition, I found out after much digging that it is the validity of our relationship that is in question...not something that was said in the interview. Basically the consular officer who interviewed my fiance was not satisfied by all of our proof...although she did not look at all of it to make a fair assessment.

There are steps that the petitioner can follow to find out what is going on. I would be more than happy to share that information. This is exactly what I did:

1. Called the State Department to find out what this really means...they directed me to the consulate.

2. Called the consulate directly and talked to the chief consular officer. This really got me no-where, but the man did talk to me.

3. Called my Senator's office and gave them all the information regarding the interview and events which transcribed therafter. My Senator's office made a congressional inquiry to the embassy and the consulate.

Once I got the response that Casa sent to my Senator, I did know that it was the validity of our relationship that was in question...basically my fiance was not convincing enough to her...we had no idea you needed to be assertive whatsoever. It will be at least 6 months before I hear anything from the USCIS in California. However, I am ready with all of our proof of a valid relationship, and will continue to compile it in the meantime.

This is a HUGE setback for anyone going through this process. For me and my fiance, nothing is more important at this moment than us spending as much time as we can together. We know we will be waiting a long time to get this letter, and there are no guarantees we will be approved when it is all over. Then we will decide which option we want to take to be together as we deserve. For now, I am going back to Morocco to be with my fiance in March for nearly 3 weeks.

221g is a Temp Denial.

they< embassy > needs more information.

found out what they are asking for - the paper should tell you what it is.

also 221g means more bloody security checks < admin review and/or admin processing >

if the petition is sent back to the servicing center. heads up the USC < the american > could get interviewed. it happend to me so thats why I am telling you.

this takes several long months of waiting in the mean time.

it took me 6 months to get my interview here in the US.

I am at the office- sorry..

I wanted to add this ...

when I got approval of my petition it took another 5 months to finally reach the embassy.

Thank you for your replies ..........I will be there for the interview ! If nothing else I will know I was at least there for support ! I understand there has to be security checks . and proof of relationship , but this is not fair ! My friend said an HOUR he was questioned and then without even looking she said "I don't believe you " I pray for all of you who are going for interviews , or have been unjustly given this 221g without reason! At least I know what we are up against here !!!

if you click on my signature you will see ISL experiance.

in there - has a specail entry for < USC interview > I have my interview what will give you an idea of what questions they will ask YOU. my interrogation lasted 2 hours.

also let me also tell you that my husbands parents and his family was visited randomly < field investigation > 2 times. 2 diffrent dates.
