I believe this is legal - Petition/Mom & Dad - Within a year. When they get here, either petition little bro as a LPR after little bro gets here on his tourist visa. ( Little bro enters legally, just visiting, but decides to stay) then do a AOS on little bro. What do you guys think? Then everyone is here within 2 years.

My original question is has anyone petition their parents who are already in the US? what was the process? what was the cost/headache effects to it?

It is absolutely NOT legal. It is called visa fraud. #######.

How is it fraud? They got their tourist visas legally. Little bro will come in the country legally. Petition is done after he comes in. He adjust status? No river crossing here.

Time to consult a immigration atty.. This site is very nice and helpful in most cases.. but their seems to be alot of amateur atty's here..

I've seen alot of variations in the years.. If you are here on a tourist and find love, you marry a USC.. You spouse files a I130 here in the US and Adjust..

JUst trying to figure out the most cost effective method.

If your illegal now.. Just wait for amnesty.. pass the english test and pay ur back taxes is another route...

When they ask your brother at the POE if he intends to return to the Philippines, he should tell the truth - that he has no intention of returning and that he is using his tourist visa to enter the US so he can do an AOS. Good luck with that. If he said that he does plan on returning - then he is lying.

Your brother cannot wait in the US for a green card. It is that simple. You will turn him into an illegal alien. Good luck getting a green card. My amateur attorney's guess is that he would be subject to a ban.

Also, could you please point me to the line where illegal aliens are getting amnesty? Sure would like to see an official government announcement.

It is visa fraud if you intentionally use one visa for a different purpose than for which it was intended. You mention having the little brother arrive on a visitor visa - and just staying to adjust status. That is illegal. The intent is to try and bypass the proper immigration process. It can really come back to bite you and the consequences of visa fraud are severe, often including a lifetime ban from ever being allowed to enter the US.

As a reminder, it is against the TOS of Visa Journey to condone, support or assist in any type of illegal immigration activity. You have been given the correct information to bring your family members here in the most timely way which appears to be about 6 years. Trying to find shortcuts through the process you suggest is illegal as well as a violation of TOS for this site.

Since you have received the information you have requested - even if you don't like the answer - I am closing this thread to avoid further discussion of illegal activities.
