Petition Mother/14 year old minor sibling

I will be a USC soon. I plan on petitioning my parents, but i also have a 14 old bro who I understand can't come right away with my parents..

Both my parents and bro have tourist visas. Time is of the essence. very precious.. My dad wants to work.. Is it faster for me to do and I130 while they are in the US and then they just adjust, get a work permit? Or do it while they are back in the PHils?

As far as my sibling bro, what if he's here legally as a tourist and I petition him? or is it better for my parent to become US citizens and they petition him?

Any suggestions?

2. Dad as LPR files for mom and son - each would have their own I-130. (4-5 years). Both would be in the F2a family preference category (LPR petitioning for a spouse or unmarried child under age 21.

You have legal ways to get your entire family to the US within 6 years. Don't be stupid by using shortcuts that saves a few months and put your family's chance of immigrating to the US at risk. Stupid includes coming to the US on visitor visas with the intent to adjust.

It does look absurd if you it would take 23 years to petition a sibling...so many things can happen... good thing there are other options that are as legal.

Every country has the right to determine who is allowed to immigrate into the country. Why is this absurd? No one is entitled to immigrate to another country. I doubt that I have any right to immigrate to the Philippines.

Family based immigration is about reuniting family. Reunification is primarily important for those who may be dependent on the USC; this includes a spouse, minor children and parents. In most cultures, people are generally not responsible for their married children or siblings. This is why it takes so long for married children and siblings to get visas versus a spouse, minor children and parents.

I think if immigration was an entitlement, half of the Philippines would move to the US immediately. The reason for the 23 years wait is that there is an extraordinary number of Filipinos who petition for their siblings.

Using a tourist visa to get around immigration law would be visa fraud. You have already said that you would bring your brother into the US with the intent of lying at the POE and then trying to file for AOS, this would be a misrepresentation and visa fraud and could lead to a lifetime ban on entry to the USA..

Even if your brother came on a tourist visa he can not remain in the USA until a visa is available for him. He would have to leave the US and complete his immigrant visa from his home country. It would be 4 - 5 years for a visa to become available for your brother. there is no way you can get them all here at the same time.

Yes there are many of us who have file for our parents. The process can take anything from 4 months to over a year.

You believe it is legal but it is not - it is in fact illegal to do what you are proposing. You have a legal path that takes 6 years to reunite your family. Risk it all if you want and good luck if you get prosecuted for immigration fraud and your family is ban from the US. How does your husband feel about your idea? Is he willing to invest time and money if the immigration folks discover your plan?

6 years to reunite the family = legal, dad can be over in a year and eligible to work.

2 years to reunite the family under your plan = illegal, can be expensive, can be subject to criminal charges, can result in revocation of green card, can result in deportation, can result in ban from the US.

Time to consult a immigration atty.. This site is very nice and helpful in most cases.. but their seems to be alot of amateur atty's here..

I've seen alot of variations in the years.. If you are here on a tourist and find love, you marry a USC.. You spouse files a I130 here in the US and Adjust..

JUst trying to figure out the most cost effective method.

If your illegal now.. Just wait for amnesty.. pass the english test and pay ur back taxes is another route...

Because the use of the tourist visa is to visit; not to pursue permanent residence. Quite simple. I didn't write the law, and you don't have to like it; but it is what it is.
