Hi everyone,

I think I have asked this before but I can't find my post anywhere and can't remember what the answer was. Anyways with my VISA for I130 IR-1?? can I just go down to the border and get it activated without physically moving there that day. I would like to get it activated, apply for SSN and start applying for jobs while continuing to work in Canada (only for a couple of months). Is this possible or do they want you to import your car and personal belongings at the same time? Basically, I just want to activate and come back the same day. Thanks for any info guys.

How did you do that? I swear I just spent about 30 minutes looking through pages and search key words and I didn't come up with anything! Thank you! I read it over and now remember. Has anyone on here actually 'activated' GC and then turned around? Anyone know of anyone so that I may email them and find out some info? Thanks again.

I was reading about people activating their visa and a lot of people gave advice about not doing it until you are ready to move. Is that because they have a different visa than myself or something else?? I just want to make sure that I don't screw it up when I go.

I was talking to my lawyer about doing the exact same thing and also U.S. Immigration they both told me that when I activate I am moving to the U.S. Should I continue to work/live in Canada to make sure I put that on my U.S. tax return but my visa could be in jeopardy as I did not take up residence.

The whole thing is mute anyways as I showed up 12 hours after my expiry date...so here I am in Canada with "Cancelled Without Predudice" stamped on my visa...in case anyone wonders what they stamp on an expired, unused visa. Needless to say I had some explaining to do to my loved ones....

For the most part, I can't think of any reasons you could not activate your Visa even if you aren't moving yet -- so long as you will within a year. Your taxes will be complicated as you will no longer be considered a Canadian resident -- it may effect your insurance, for instance. You will pay higher taxes in Canada. You will also have to declare that income on your US taxes. The real issue is that if you are a non-Canadian resident and you work there, do you need a work Visa? This I don't know. You should speak with your employer.

My husband activated his visa and then worked remotely from the US for his Canadian company for a couple of months while they processed to have him transfered to the US. Is that an option for you?

There have been many cr-1 (ir-1) that have gone to the border, "activated the visa" (bad terminology,lol) then immediately returned to Canada!! k1'ers can NOT do that as it is a 1 time use!! And yes, one has 6 months after the interview to use the "visa" I have read that some have had the interview and they knew they would not be moving to the USA for over 6 months, so Mtl just doesnt issue it then, they issue it closer to the moving date.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

I went 6 months after it was issued to me however I arrived at U.S. Immigration to activate it and I was 12 hours late..it was the day after..June 16th had to activate but I arrived the morning of June 17th.

The real issue is that if you are a non-Canadian resident and you work there, do you need a work Visa? This I don't know. You should speak with your employer.

Canadians never need a visa to work in Canada.
