Timeline

I see no instructions for applying for a K-2 visa for the child of my fiance. On the I-129F, there is no place to say that I wish a K-2 for the child. There is only a place to list the fiance's children - regardless of their age or eligibility or interest in receiving a K-2. What must I do to get a K-2 visa issued along with the K-1 for my fiance, and to specify that the child will not come initially but will follow within a year?

If you list the child he/she is eligible for K2 visa. My stepson received his K2 after medical and interview. It was only valid for 4 months. Even if the child doesn't accompany you it is required to list the children of your fiance on the K1 application.

So there is nothing to do when filing for the K-1 in regards to the K-2, and no additional fees? So the child simply shows up at the medical exam and interview with my fiance, or schedules his own interview and medical exam later, and there are no forms involved at all?

My daughter (K-2) followed-to-join me in the U.S. and I simply had her listed on my I-129F initially. Then, at my K-1 interview, I told them that she was not accompanying me to the U.S. at the same same as me, but would follow later.

You must have the K-2 visa in hand within one year of the K-1 visa, so make sure you allow enough time for the medical and gathering of all the documents.

My daughter's K-2 visa was valid for 6 months, just like my K-1 visa.

Sept. 13/07... N-400 sent to NSC

Aug. 21/08... Interview - PASSED!!!!

Sept. 2/08... Oath Ceremony

Sept. 5/08... Sent in Voter Registration Card

Sept. 9/08... SSA office to change status to "U.S. citizen"

Oct. 8/08... Applied in person for U.S. Passport

Oct. 22/08... U.S. Passport received

DONE!!! DONE!!! DONE!!! DONE!!!

Apr. 6/05... DS-230, Part I faxed to Vancouver Consulate

May 26/05... K-2 Interview - APPROVED!!!!

As the USC, you are NOT applying for a K-1 but petitioning to determine the eligibility of your alien fiance(e) to apply for a K-1 visa at a later date. If the fiance(e)'s eligibility is approved then any child of the alien is provided automatic derivative benefit. List the child(ren) on the I-129F.

For now, all you need do is list ALL children on the I-129f. List ALL children, even if they do not intend to come at this time.

At the time of the interview they will apply for a K-2 visa based on the approved petition. The procedure is basically the same as for your fiancee. Be aware EACH applicant must have a medical, pay the visa fees, pay the AOS fee when they arrive and you must provide an affidavit of support for each applicant. K-2s can be issued at the same time as the K-1 or within one year after. That means ONE YEAR, not one year and a day. We did both a K-2 at the time of my wife's K1 and another 10 months later for our older son. No problems.

If the children are under 16 (18 in some countries) you will need a letter from the father granting permission to leave the country permanently and reside in the USA permanently. If children are over age 16 they will need police certiticates. All of their documents, same as for your fiancee, must be translated. It is actually a separate and complete visa application process for EACH applicant.
