Interview, NOv. 19. 7am,.

YOung Lady consul. She seen my CENOMAR and Divorce Decree and put OK on both docs.

Didnt ask about my past marriage, ddnt ask why it was never reported,.

She was definitely pleased that my fiance now is younger than my xhusband.

Main points of the case that she checked was

- married within 90 days

- I left the US before visa expired

- filed k1/k2 after Divorce finalized.

Very unexpected quick questions:

Name of fiance's parents.

Name and Age of his Daughter.

and she said. Your k1/k2 is approved and Welcome to America again.

Thank you all!!!

so happy for u guys!!! congrats and God bless to you both, u deserve to be happy

So happy for you, nydvo!!! CONGRATULATIONS!!!!

This case proves conclusively that a US divorce obtained by a Filipino spouse is accepted and recognized by the US Embassy as long as the marriage occurred in the US.

For marriages that occurred in the Philippines, however, divorce proceedings still need to be initiated by the foreign spouse to be recognized.

Congrats again, nydvo and welcome back to the US! I'm really, really happy for you!!! :star:

That was the most interesting thread I have read on this board, I am sorry I did not find it earlier as it keep me entertained for a long time today. It looks like you were able to get past the (nuts) as in nutmagnet, and some of her following, (attracted by the magnet) (I understand why she uses that nick name lol) It seems they have nothing better to do in life than to criticize other people, and give out as much misinformation as I have ever read in a forum like this. What a load of C—P, that stuff was.

I wish you both the best of luck in you future together, and unlike some that posted on this thread that believe they have never done anything wrong in their life, and therefore think they are free to judge others, it is good to know that the USEM focused on the true issues, and not some morals, that others think we should be judged by. Most of us do understand things happen, and it may even be out of our control, and it is so nice to know we are allowed second chances at finding happiness in our lives.

For those passing your own moral judgments, if you have not taken the test for US citizenship, you may want to study up a bit, on what principles this country is founded on.

I also wonder in a country that does not allow Divorce, why is it having mistress seems to be ok, including the ex president, but then that is their business not mine.

Hello all.... This is Ray, nydvo's fiance. I wanted to thank all the people who tried to understand our situation. I really do appreciate the responses. You all read the post my fiancee put here and know that the interview went very well. We had prepared for it alot and knew we had all the required papers, documents, proofs, etc.... but was just nervous about the questions that might be asked. Lets just say that I didn't believe the interview went as smooth as it did. :-) It is a big relief to be past this part of the process now.

I dont imagine NutMagnet will have anything to say!! lol or if she does say anything I am sure she will think the consul was incompetent or didn't do her job properly, etc.. I guess you cant please everyone!!!

Thanks again for all the nice wishes!!!

There are many church annulments in the Philippines. One of my friends went through one in 1999. While the Catholic Church may not call it "divorce" they allow annulment of marriage but it is a long and very tedious process. And expensive too.

http://www.americancatholic.org/newsletters/cu/ac1002.asp

The Catholic Church presumes that marriages are valid, binding spouses for life. When couples do separate and divorce, therefore, the Church examines in detail their marriage to determine if, right from the start, some essential element was missing in their relationship. If that fact has been established, it means the spouses did not have the kind of marital link that binds them together for life.

The Church then issues a declaration of nullity (an annulment) and both are free to marry again in the Catholic Church.

Don't depend the US Embassy Manila to assist you in circumventing Philippine law. You seem to be looking for a fast and clever way out of getting a proper annulment.

For a K1 visa you must have the legal capacity to marry. You say that you filed for, and were granted a foreign divorce which you know is not recognized under Philippine law, and you think you can sneak by because, so far, your CENOMAR is clean.

You stated that your ex-husband is "Spiteful" and that also you filed for AOS. What will your ex husband say when Immigration knocks his door and asks him where you are? Also why you have not completed your AOS because they will think you went TNT.

If you are serious about your new boyfriend and are indeed serious about having a family, and not just coming to the USA for Immigration benefits. Then you need to be honest with him and tell him that you are not ready and that you need to get a honest and full annulment before wasting time and money on your plan of fraud.

Is there any wonder why Manila is one of the top 3 high fraud Embassies?

Thanks NutMagnet for your sentiments.

My k1 visa expired Aug.5, 2007.. I left Aug.3,2007

I got married on the 87th day of the 90days period...and we filed for the AOS>

The whole time i was in the US, it involved physical abuse.Everytime he has bipolar attacks, he sent me and my son 4 times to the nearest motel and let us stay there for 3-4 nights just becoz he felt like it.. I never call the police, but our neighbors did. I never show them my bruises coz i dont want my exhusband to be in trouble (POOR USC HUSBAND VICTIM HUH!).. July 27,2007,..another police thingy happened in the house, the police want me to go to the shelter coz they said im not safe anymore to be with the guy., I told them., I cannot just drag my son to the shelter and be a burden to anyone..so I said, im just gonna go back to the Philippines...

Oct. 2008 to January 2009... My exhusband "made me believe" that he will file the divorce.. so i sent him signed paperworks twice. coz he lied to me twice... he made excuses why he werent able to do it.. but eventually,. he admitted., HE WILL NEVER FILE THE DIVORCE coz he SAID he dont want me to be married again..But we were already separated since AUG>2007.

And yes,,. I do deserve a second chance... I hired a lawyer in the US to do the divorce. and I chose to just do the DISSOLUTION OF MARRIAGE. I do have a choice to do the DIVision of Property coz we had some acquired during the marriage, but I know that he worked hard for it.,even though some properties has my name on it., but he deserved all of it...

When he found out that i got a boyfriend.. He flew all the way to the Philippines from DEC> 2008 to May 2009, and went to our house and took back everything that he gave me and to my son., from the toys to the clothes, to everything that he knew its from his money. He atleast had lots of balikbayan boxes for all of it. he took back the engagement ring, the wedding ring, ... everything.... my family said, if its gonna make him happy., then so be it....

I'm so sorry to hear about earlier situation, and I'm so glad this time is working out for you.

You could have stayed in the US after leaving your previous marriage if the physical abuse had been reported. I know you cared about that man and didn't want him to get in trouble. But you also have to think about the next girl who will come into his life.

Report these types of things ladies, save the next woman misery and heartache.
