AOS forms complex questions

Good day everyone.

As we all expect it to be, this process is indeed such a painful, disappointing and hurtful in our lives. My husband sent our AOS last week together with our Co-sponsor's forms. We thought it'll all end there but we were wrong. Now, we have new sets of Documents required from us to which we never expected we will be providing.

From Ling Che's shortcut it says there 3 years of income tax returns will be enough to prove stability. But I don't know why NVC is saying that we are missing these Tax returns, and also employment letter, pay stubs where in fact all the ones required were all there. :(

We have endless of things to consider on our RFE list, but these are the ones that require other people's feedback for me and my husband's enlightenment. I am positive that someone, somehow will input the best knowledge s/he has to help us. Any input will be deeply appreciated.

(all the errors were found in I-864A)

• A photocopy of the applicant’s I-864A is required for each accompanying dependent listed in Part 3 of I-864A and Part 2 of the I-864A. Copies of supporting documents are not required for accompanying dependents.

--I don't know what they meant by this. :(

• You as a household member have not provided proof of your relationship to the sponsor.

--Does our Co-Sponsor (my Mom in law) needs to submit my husband's birth certificate? or something?

•A written statement/explantion is required if you are/have been unemployed, retired or dependent as to why tax returns were not filed.

--My mom in law is employed and we even provided the employment certificate, what does NVC mean on this matter?

Schedules are missing for the years ---2008, 2007, 2006, 2005.

--What does "schedules" mean?

I know its quite an inquiry but please, shed some light to us. Thank you very much!

Are you confusing the I-864 and the I-864A? Part 3 of the I-864A is where the sponsor (mother in law) signs the form. Part 3 of the I-864 (your husband's document), and part 2 of the I-864A, is where other immigrants are listed. Are you bringing children with you? Or was there an error in completing the forms?

Your mother in law needs to suply proof of the household relationship. A birth certificate (petitioner's) showing the mother's name should be sufficient.

Mother in law needs to supply full and complete tax returns (including all sections filed) or IRS tax transcripts for the past 3 years. Not only an employment letter.

Schedules are components of a US tax return.

Clearly someone has not understood the forms properly. The instructions are clear. If your USC husband and his parent do not fully understand the documents it may be worth them paying someone to help them comply with the requirements.

Are you confusing the I-864 and the I-864A? Part 3 of the I-864A is where the sponsor (mother in law) signs the form. Part 3 of the I-864 (your husband's document), and part 2 of the I-864A, is where other immigrants are listed. Are you bringing children with you? Or was there an error in completing the forms?

-We didn't confused the forms. My husband filled out the I-864 and my MIL filled out the I-864A. There were just few errors on the way my MIL filled hers.

-This is a good suggestion. However, some information is available here in Vj and kind individual like you can contribute a very meaningful answer so I don't think paying someone to do this not so simple thing is necessary. :)

sometimes the uscis says you need to submit stuff that you already submitted, but whatever the reason, whoever's fault it is, it's better to just comply with the docs for the RFE, you'll be ok

As in what did you send - exactly - with the I-864 and I-864A (the supporting documents as well).

One reason I ask is because you say you sent last 3 years tax returns but don't mention if you sent supporting document for them (i.e., W-2's, 1099's etc). Nor do you mention what exactly your MIL sent with her I-864A. So rather than guess - it is helpful for folks to know exactly what was sent.

1. Bar Coded cover sheet

2. Completed and signed form I-864

3. Completed and signed form I-864A for my Co-Sponsor

4. Last 3 years IRS Tax Transcripts of my Co-Sponsor

5. Original Employment letter of my co-sponsor

6. Original Pay stubs for 2008

I am not so familiar with Taxes in the US, but I don't know if one of them is the derivative of W2's.

2.My Husband was still at school that time and right now he just graduated from college. He worked for a while but then what he earned was not that high to which the US threshold requires for a tax. So he wrote a written explanation about it.

3.About showing a relationship between the sponsor and co-sponsor. Will the Birth Certificate of my husband be enough to prove that our co- sponsor and him are related? or we need another proof?

6.Yes, pay stubs of my MIL.

But what do they mean by this...

You are 100% correct. USCIS wants all the forms. Examples of schedules are Schedules A, B, C, D, E, F and so on. Good luck on your journey.
