Hi everyone,

As we were getting all of our stuff together to send off for AOS, I couldn't find my I-94. I've spent an entire day turning our apartment upside down but can't seem to find it. However, as the I-94 had already expired, I just wanted to make sure that they needed it. Obviously it could still turn up but just wondering whether my only option is to send off for a replacement. I did have an infopass appointment in Chicago at the beginning of February about a CBP ####### up when I entered the country. I can't remember if I took it with though.

Any help or suggestions?

Check inside your passport - it should be stapled there. Yes, you do need it for AOS. If it isn't in your passport and you can't find it, you will need to file for a replacement I-94 (it's not cheap) and include proof of filing for the replacement with your AOS application. Good luck in finding it.

Sorry guys, this is all a rush as I'm due to fly from Chicago to Denver, Colorado later this month. Now I've read on here that some people think I could get stopped by Immigration and I was just wondering whether anyone else had experiences of this or knows of any topics on this forum. I'm more worried as I wouldn't even have an I-94 to show. Even though the stamp in my passport has the date of the expiry of the I-94 written underneath it.

Interesting if the USCIS took it at your infopass - that was probably not the right thing for them to do but certainly, I would either try calling them or make another infopass appointment and verify that they do have it. If they have it you can then state that on the AOS application where you are supposed to submit it. The problem with calling is that you don't speak to an immigration officer - you speak with a call center operator who has a script to read. She may or may not 'escalate' the call to an immigration officer. With the uniqueness of your situation, however, you may be able to speak to an Immigration Officer or get a service request filed.

Regarding travelling - you should have no problems. The date is written inside the passport so at the very least you have that to show you legally entered the US. Regardless, it is highly unlikely you would need any immigration documents for domestic travel. They will only be using your passport for identification purposes, not immigration control purposes. Many Americans travel just using a Driver's License for identification, so you should be fine.

Yes, they need a copy of it.
