I want to bring my daughter in the US. I need advice.

I'm an LPR and I got a minor daughter. I want to petition my minor daughter so she can join me here in the US. I'm eligible to apply US citizenship in 2 years. Which is faster petitioning her with my LPR status or petitioning her as US citizen? How long it would take?

You can apply for your daughter right now as an LPR. When you become a USC, you can upgrade the petition and it will be a shorter wait versus waiting to file until after you become a USC.

If your husband is a USC, he can file for your daughter as his step-daughter. This would be the quickest way for your daughter to get an immigration visa.

How old is your sister?

That crazy over under 21 year old rule. Six pages of I-130 instructions explain what you can and cannot do, once you know how you are classified, can go to the USCIS site and learn the processing times. Think instead of using years as the unit of measurement, centuries would be more appropriate.

For a LPR applying for a minor child says I-130 Petition for Alien Relative Permanent resident filling for a spouse or child under 21 January 15, 2006

For USC applying for a minor child says:

I-130 Petition for Alien Relative U.S. citizen filing for a spouse, parent, or child under 21 5 Months

For a USC applying for an unmarried child over 21, says:

I-130 Petition for Alien Relative U.S. citizen filing for an unmarried son or daughter over 21 January 08, 2004

But have no idea how accurate these delays are, would think they would be a bit more merciful for an especially young child even if you are a LPR. Wonder why your deceased husband didn't apply for her the same time he applied for you.

She applied in Jan 2007 as an unmarried daughter over 21 of a LPR. Our Dad will be applying for citizenship any day now as he just reached his 5 years.

If you read carefully, Meblue asked about her minor daughter. If she applies for her daughter now, it would be in the F2a category (LPR petitioning for a unmarried child under 21). Upon gaining her citizenship, her daughter if she is unmarried and under 21 at that time would be moved to the Immediate Relative category where a visa would be available to her immediately. It would take 6-12 to process the paperwork.

Your sister is not a minor and the rules are different for her. Your sister's case is in the F2b category (LPR petitioning for an unmarried child over 21). Once your father becomes a USC, he can inform USCIS (if the case has not been approved) or the NVC (if the case has been approved) about his citizenship and move the case to the F1 category (USC petitioning for a child). For England, visas are currently available to F1 cases with a PD of May 15, 2003 and to F2b cases with a PD of July 1, 2001. Your sister would shave about 2 years off her wait time. Your sister would not qualify as an Immediate Relative of your father's because she is over 21.

Your sister also would have the option of being in the F3 category (USC petitioning for a married child). She can get marry AFTER your father becomes a USC. Marriage before your father becomes a USC would result in an automatic withdrawal of the petition for her. In the F3 category, her husband would also qualify for a visa. The current PD for F3 is Dec. 15, 2000. This would be a good option if she does not want to be separated from her husband for 4-5 years if she choose to petition for him.

In the F2b, F1 and F3, your sister's unmarried children under 21 (if any) would also qualify for visas.

This may be more information than you need. It seems that you are new and may benefit from the information above.
