Hello, I have two questions (more like confirmations on my understanding) on the processing of forms.

I received my NOA1 on August 3rd, 2009 after submitting my I-130. It was suggested that I register on the USCIS to track the form's "progress".

Question 1:

In looking at the timelines at USCIS, it says five months for processing I-130s? In other words five months until I receive the NOA2?? Or is it five months or less (golly, I hope it is less).

If i read the instructions they say that if the office is not meeting its five month goal it will post the date of the last completed form. In the I-130's case at the California processing center, (the one on this site is out of date) https://egov.uscis.gov/cris/processTimesDisplay.do in the time column it says 5 months. So again, is it five months or less when they post the months and longer if they post the date of the last completed I-130, correct?

Question 2:

Also, I am following the shortcut directions on this site posted here for quick processing of the CR1/IR1 visa: http://www.visajourney.com/wiki/index.php/...he_NVC_ShortCut and I guess, these record times are for AFTER receiving the NOA2? :blink: I guess I misread the timelines in my haste and told my spouse that we could have her here in as little as 21 days :whistle::blush::crying: .

Question 1:

The 5 months is there goal but it can be soon or it can me much later, depends on FBI name search and if you made any error on your forms.

Question 2:

If all goes good you can maybe say 10 months. 4-5 months to get NOA2 and 4-5 months to complete. I can be done sooner or later. looking at the number now of others people this years, it look like 10 months is a nice number to say.

Its 5 months or less. Some lucky people got it in a month while for us it took about four months to NOA2. Once it goes to NVC

it seems to go quite fast. Make sure you have all the supporting documents for NVC stage ready meanwhile to save time.

Its 5 months or less. Some lucky people got it in a month while for us it took about four months to NOA2. Once it goes to NVC

it seems to go quite fast. Make sure you have all the supporting documents for NVC stage ready meanwhile to save time.

It boils down to pure luck of getting a NOA2 quickly and within a reasonable amount of time.

One person can be approved within 17 days, others the full 5 months process times. Its a ####### shoot.

Ain't that the truth! USCIS must throw everything into a bin and then its the luck of the draw! I can't imagine how else there can be so much disparity.

When I asked an IO about the "Priority Date", he said once you apply as a citizen there is no priority date. They don't seem to care much about processing things in order received.

I-130 For Spouse

10-30-90: Petitioner enters US via NAFTA 1, later H1-B

10-26-96: Petitioner becomes LPR.

07-06-06: Delay due to N-400 processing begins. (Background check delay)

03-03-07: Married

06-09-08: Apply as LPR

02-26-09: Petitioner becomes US Citizen. Delay due to N-400 ends. (2 yrs, 8 mo)

02-27-09: Infopass. Attempted upgrade. Did not work. (found out later)

03-24-09: Timeline for USC I-130 begins. Faxed in Upgrade.

04-23-09: Infopass. Verified Upgrade. Never any official receipt.

06-23-09: Infopass. Check history. Nothing new.

07-23-09: NOA2

NVC IR-1

08-11-09: Case Received & Number Assigned

08-12-09: In AVR. Gave operator emails.

08-13-09: Email received: DS-3032 & AOS bill generated. DS-3032 emailed. AOS bill paid.

08-14-09: DS-3032 sent overnight, I-864 sent overnight

08-18-09: DS-3032 accepted, IV bill generated. IV bill paid.

08-19-09: Email recieved: DS-3032 accepted & IV bill.

08-20-09: DS-230 sent overnight

09-01-09: Case Complete

09-02-09: Email received: Interview Date.

Manila

10-08-09 -10-09-08: Medical. After chest xray, further testing required

10-13-09 -10-15-09: Sputum Tests

10-19-09: Result of Sputum smear test. Negative.

10-19-09: Original Interview POSTPONED

12-10-09: Result of Sputum Culture Test

12-16-09: Medical Appt.

xx-xx-xx: New Interview date

There are some factors in the timeline.

1 is the FBI name check, depending on your name you could be delayed.

2. After it get to the desk of someone, they will screen the country. if it is high fraud one or not.

3. Did the person go on vacation after it was placed there.

4. Is there any error or miss information in your filing.

5. Is there a congressional inquiry attached.

6. Maybe even prejudice for the good or bad. This is just a shot in the dark I have no knowledge of this.

7. Workload of other visas. In April the Business visa start to get working on. so before April they try to get though a lot of visas.

This is just my opinion and not base on all on fact. just got from reading this site.

I'm one of those 'lucky' ones that got NOA2 in 9 days.

I have theories behind why -

We have already proved to anyone that our relationship is real and true - I immigrated to Canada from the US to marry my husband. We have, in a sense, been pre-approved. I made sure in my cover letter for the I130 to alert them to this.

My husband's last name is rare. There are only two people in Canada with his name - him and another man.

I do wish everyone here a quick and speedy visa process.

so you where in Canada at the time you did a DCF ?

We did not DCF. Filed at VSC. I am also still living in Canada.

I think the fact that you're living together, and have been for some time, also makes things easier. My husband and I have never lived together, have no shared assets (believe me we tried), etc so anyone looking at our case has to spend more time on verifying the validity of the relationship...and the fact that you're together now during filing, well, you're a jammy so-and-so :P You must have been over the moon to get it so quickly! I must admit I thought that when CSC/VSC received applications they sorted them into country piles, so to speak, and then processed them in that way...but now I see it's just one big pile!!!

Hehehe. We've been living together now for almost 4 years (all in Canada). I literally freaked out when I got the email. It was entirely unexpected. I thought that they arranged applications by month received then worked from oldest to newest. Who knows!

So how come you didn't file DCF, Malrothien? It would have been even quicker!!

We've only been doing this for a month, but I can already see there's no real rhyme or reason how the service centres work through those applications lol.

We didn't DCF because initially we didn't want to go to Montreal (only consulate in Canada that does DCF). However, USCIS had a different idea for us all together and we are going to Montreal anyway!

NVC

July 8, 2009 to August 10, 2009 - 28 days

Interview Assigned - December 3, 2009 - FINALLY!!

Medical - December 14, 2009 - Passed

Embassy/Interview - January 26, 2010 Montreal, Quebec Canada - 167 days PASSED!!!

Port of Entry - February 26, 2010 Baltimore International, Maryland

USCIS -- ROC package sent off

November 26, 2011 to Vermont station November 30, 2011 received NOA1December 16, 2011 received biometrics appointment.

January 04, 2012 Biometrics

September 2, 2012, RFE Received.

September 22, 2012 RFE responded to

October 15, 2012 ROC approved, 10 Green card on its way.
