I am preparing for our AOS interview. My husband and I live in a house owned by my family. We do not pay rent. So we do not have a lease. Will this be a problem. THE FOLLOWING IS THE EVIDENCE I HAVE COLLECTED. CAN SOMEONE TELL ME IF THIS IS ENOUGH? ANY SUGGESTIONS?

That should be enough information. I just had my interview yesterday and they asked for...

documents:

-copy of birth certification (benef.), copy of both our passports, copy of driver's licenses, copy of i-94, copy of marriage certificate, ead ....(originals too)

- social security card (beneficiary)...if you happen to have it already.

and any bona fide marriage information (the IO specifically said "What do you have to give me?"):

-1040 from 2008, joint car insurance, joint bank accounts, joint lease, electric bills, car registration w/ our address, cell phone transcripts, lots of pictures

(business insurance, fictitious name, contracts, 1099s - the petitioner is self-employed)

At the end of the interview, I was approved!

You should be fine with all the information you have. You can explain your living arrangement when the IO asks.

You may want to show the IO officer something that explains that your family owns the house. Maybe to show that you are related them (your last name/maiden name matches the mortgage). It's up to you though.

06/15/09 Notified USCIS of incorrect name spelling

06/20/09 Received letter from USCIS- name corrected

06/27/09 Received Interview Letter for 8/13/09

07/12/09 I-765/EAD approved! (online)

07/16/09 Received EAD!

07/20/09 Applied for SSN.

08/05/09 Received SSN (mail).

Hi!

From what I've read there are alot of "suggested" types of evidence you can submit - joint tax returns, bank accounts showing comingling of funds (such as direct deposits of payroll checks), joint credit cards, life insurance listing one or the other as beneficiary and adding your spouse to your health insurance.

The house deed/rental lease and/or car note are other suggested types of eveidence - some may have more weight than others - but no everyone has it all. So I would go with what you have & good luck to you both!

I had the same problem as you and what we did was have my parents-in-law sing a letter stating that they were the owners of the house and that we have been living there since we got married. Make sure to include their complete names as well as yours and the complete address where you reside. Thas as good as a lease.

Sorry, not convincing enough. I read online that You need affidavits from FRIENDS too. And the people you live with. Affidavits from relatives are not heavily convincing, so bring affidavits from friends and coworkers who know you and your spouse very well.

I'm sorry, but I would have to disagree with you. I don't see how affidavits from relatives are not convincing but from friends are, that does not make sense. Anyways I hired a lawyer and he told me that even though affidavits are not harmful to the petition they're not very helpful, that they are too easy to make up and that IO does not take them in consideration that much. Besides, what i recomended to the OP was not an affidavit from his parents stating that the relationship was real...I reccomeded a LEGAL document stating that they live at the owner's house at no cost. They can include document of ownership from the parents or lease to make it more convincing if they want.

OP, It doesn't have to be notarized, but make sure you have the signatures from both parents with their full names. I showed that at my interview and the IO was satisfied. Good luck on your interview.

You should be fine. You usually do not need that much. We walked in with a stack of items (joint bank statements, credit card statements, joint tax return, health insurance cards, life insurance beneficiary forms, and pics). The IO wanted to see the joint tax return and one other type of evidence, we used the credit card statement.

No problem with needing a lease etc. We live in my house (I had it before marriage, and have not adjusted the deed), so we too had no lease, and we had no deed to show joint ownership. It never came up. If it comes up, just explain your situation. You have enough other evidence already.

We were in the same situation as you, living with family not paying rent. What we did was got our family to write a letter confirming that we live there together and the date of which we moved there. That was sufficent evidence for them and my greencard was approved.

AOS Timeline

10 Jan 09- Entered US under VWP

28 Mar 09- Married

6 Apr 09- Sent AOS paperwork to Chicago Lockbox

8 Apr 09- Received by USCIS

15 & 16 Apr 09- Checks cashed

19 Apr 09- NOA's received

30 Apr 09- RFE received

5 May 09- RFE documents returned to USCIS

7 May 09- RFE documents received at USCIS

14 May 09- Biometrics appointment

15 May 09- EAD Card Production Ordered (apparantly!)

15 May 09- AP Approval Notice Sent

18 May 09- EAD & AP Touched

20 May 09- EAD Card Production Ordered. Again!

21 May 09- EAD Touched

22 May 09- EAD Approval Notice Sent

We just had our AOS interview (from K-1 to conditional GC), and provided a copy of our wills, powers of attorney, insurance card, and beneficiary forms.

Hi there,

What are the evidence of marriage do we need? We have to send an evidence that bonafide the marriage... so what are these? How many affidavit of sworn by people who have knowledge of our wedding? Who are they? They should be from U.S.A?

I appreciate your help....
