somebody can help me pls i'am divorce here in hongkong and they ask me to get a cenomar is this will affect my application i know even i'am divorce here the record will show that i'am married before and all i know cenomar is just for single pls help me about this somebody have idea or experience

hi just for your reply yes i knows that will be a record about mu privious marriage i'am just acking know if that will make my application hold but before we got into this situation we have our lawyer in the usa and hongkong and the point here is that our divorce is being acknowlege in applying visa going to the usa what i'am worrying of if my paper works if take too long for that cenomar coz i'am really having a hard time with my work here

hi yolly...i just would like to ask u where u got married?? in the Phils??are u a filipina or from HK? what i know is that cenomar is only issued to those who were never married ever..assuming u married in the Philippines, u need to present an annotated marriage contract, court decision and court finality that will prove ur previous marriage is null and void...did u apply as a single woman ( means never married or with no alias indicated) in ur K-1 application? if so, that maybe the reason why they are asking for ur cenomar...it mEans CERTIFICATE OF NO MARRIAGE..in my case coz m annulled too, i didnt present nor include a cenomar coz as ive said, i was married before...its only asked to those single ladies who was never married...

i was mariied in the philippines before i'am a filipina now i know that cenomar is for singleness but the other part is the marriage index and that goes me as a married before i think they just need a record of my previous marriage but i file a divorce here in hongkong maybe you will tell me that no divorce in philippines but before we start to apply for this K1 visa we as first the lawyers if i can use a divorce or is divoece in hongkongis acknowlege in us embassy so they tell its fine even i'am a filipino as long as you arrange all the paper works that support your divorce to disoved i tell from the start that i'am married but divorce now on my application so i dnt hide anything so far my question is if this cenomar is too long too have tru online coz that was the embassy ask me to apply a cenomar at the computer acctually thats what i think when i got my packet 3 i married why should i get a cenomar but now i reallized that they need a marriage index acctually yesterday we though its the pocket 4 i have receive but its because i dnt apply this cenomar so the embassy told me if i dnt apply for this the consullar officer wont set an interview date for me so we apply yesterday

As you said the marriage index you get from NSO when you apply for CENOMAR will show you are still married.

You have to notify the Philippine consulate in HK of your divorce. In turn they will notify NSO.

You may have problems if you initiated the divorce. Hopefully I'm wrong about that.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Under certain circumstances the Philippine government does recognize divorce abroad.

Divorce is not recognized in the Philippines. The only exception is Article 26 of the Family Code where the divorce was obtained by the foreigner against a Filipino spouse. As soon as the foreign divorce is obtained, both the foreigner and the Filipino spouse are free to re-marry. The reason behind this law is to avoid the absurd and unjust situation of a Filipino citizen still married to his or her foreign spouse while the latter is no longer married to the him or her because he has obtained a divorce abroad.

On the other hand, if a Filipino spouse migrates and obtains a divorce, the latter may be recognized in the foreign jurisdiction only but not in the Philippines. This is because Article 26 applies only to alien spouses and not Filipino spouses. In this case, if the Filipino spouse who obtained the divorce re-marries abroad, then this second marriage may be considered a bigamous marriage under Philippine jurisdiction. This means that if the Filipino spouse returns to the Philippines, he will be considered married to his first spouse, not to the second spouse despite the foreign divorce.

Since you will submit your divorce decree you have to submit also the record from the NSO of your previous marriage ( that's what i submitted before), they did not ask for CENOMAR coz' cenomar is only for single who don't have a record of marriage. Your divorce decree and the record of your previous marriage is what they need from you. Goodluck!

hi there madam yolly...in our case, whether annulled or divorced, there is one common ground---WE BOTH CANT HAVE A CENOMAR any longer..coz of our previous marriage...If u try calling or applying for a cenomar, ull not be given coz ur record here in the PI appears ur married, unless u were not legally married here that will help u maintain ur singleness...what u need is ur divorce papers and ur marriage contract both unannotated and annotated that marriage was already dissolved...just try applying at NSo,,and see what they will advise u then..

good luck...dont compare urself to those who have left for states and made it through illegal means..ur still on ur way to the interview..so give ur best and have it done the right and legal way so u wont encounter any problem later on...and i think application at nso for ur concern only takes a week if ur in the PI...
