Hello,

i have transfered to a US university after studying for 3 years in an american university in my home country. i have completed my bachelors degree in December 2008, and wanted to stayed until my graduation ceremony which usually takes place in May. i stayed until april, then two agents came to my house asking for me, they left after my boyfriend told them that i was out. after getting back i called them back to see what was going on, they came after a while and explained that i was out of status the moment i finished my degree, as i could not understand why since the visa was still on until 2011, i was put in jail as it was saturday until my case gets investigated. on Monday i was released and my visa was extended until May. i left right after the ceremony on my own expense.

which means i overstayed for like 120 days, now i am applying for a k1 Visa since my bf proposed and came to my home country.

will this really affect my K1 visa? will i be denied entry? what happened was a misinformation issue with the university, who did not inform me about my out of status, as i learned after that they were supposed to tell me.

any help or clarification would be really helpful.

Was your visa actually extended to May (in which case no overstay) or is it definitely counted as an overstay??

i actually don t know, but there was no stamp on my visa nothing, the agents were soo nice though, and i am still in touch with one of them until now :) i was given permission to stay for my graduation ceremony, which means probably that my visa was extended. i am just worried about denying my k1 visa because of that :(

If it was only 120 days, then it doesn't matter -- only an overstay of 180+ days will cause a problem.

07/08/2008 INFOPASS (I-551 stamp)

07/08/2008 Driver's License renewed

04/20/2009 Lifting of Conditions approved

04/28/2009 Card received in the mail
