When we applied for our K-1 Visa my dad was a co-sponsor for the affidavit of support. My father now does not support the fact that we are getting married and will definitely not agree to sign this form or provide his information again.

What are we supposed to do?

If we send in the information again then we definitely will not be approved because I only made 2k in the past year.

Will they deport him even after we've gone through all of this to get married the "right" way in the eyes of US law?

We're getting married tomorrow and I'm so overwhelmed by the idea of having to do another I-864, wasn't it enough the first time?!

We have no one else, absolutely no one. He was our last resort the first time we had to do this. Can I not reuse the same forms?

I haven't ever had to fill taxes on my own (20 years old, full time student, make less than 10k at a job with flexible hours). This spring and summer I had 14 hours, this fall I'll only have 7. Quick math puts me at 3818.40$ annually.

Ask someone else to be your co-sponsor.

We have no one else, absolutely no one. He was our last resort the first time we had to do this. Can I not reuse the same forms?

We have 8k saved up to make it until my husband can get a job, but thanks for your support and kind words. :) I thought visajourney had some conduct rules but I guess not.

Also you have no idea why my father doesn't approve of our marriage now so I really don't appreciate your assumption. What type of hardhearted person laughs and chastises someone in such a manner the night before the person asking questions is getting married?! We all had to go through long hard ordeals to be with our loved ones, I wouldn't expect such venom from someone on here.

Oh your relationships failed because of lack of money worries? You require money worries to have a good relationship, eh?

My family and I were already estranged, we reached out to my father for the marriage alone.

Clearly the brain doesn't kick in at nineteen for everyone, some people seem to have them missing. :whistle:

Also, you shouldn't reply to threads just to be a jerk. If you have nothing helpful to say, why reply? To troll? To twist the screw?

1. Relax, enjoy your wedding day.

2. No one is getting deported any time soon, as long as you get married in time no is going to hassle you for a LONG time if you don't adjust status straight away.

3. As other's have said you can get anybody to sponsor you, you may not be able to think of anyone right but you have plenty of time. Sponsoring someone is not a big deal. Even in cases that beneficiaries of I-864 become "public charges" the U.S. Government is very unlikely to sue a sponsor for re-payment, and even then they are very unlikely to prevail in court.

4. WORST CASE, you could always drop out of college for a semester and get a job long enough to sponsor him yourself. You only need to be employed long enough to file for AOS.

Unfortunately, there is no way around the requirement that you or a cosponsor makes 125% of the poverty guidelines for a household of your size. That provision is put there to protect the taxpayers of the US so the new immigrant does not require funding when he/she has never even contributed to the society. No, you do need to file new paperwork. The k-1 is permission for your fiance to come to the US and get married within 90 days. It is not permission to remain in the US- you need to apply another form called the I-485 (adjustment of status) in order for him to stay legally in the US, and yes you do need to file a new Affidavit of Support -I-864 . Without that he will not receive permission to live and work legally in the US.

One of the other options you may want to consider is you moving to Canada. While family sponsored petitions are required to have a financial sponsorship in Canada, meeting the minimum amount of income is waived for a married couple. If he has a job in Canada you would start off your life with a much better financial situation, and there are definitely benefits to living in Canada that you don't get in the US. Then, after a few years, when your financial situation is improved you could return to the US by filing for him as your spouse.

I know that the two of you want to get together right away, but another option you do have is to wait - wait until you are finished college and have a job and do meet the criteria for financial sponsorship. It means living apart in the meantime but many couples have gone this route - both while engaged and while married. It is a hardship, yes, but if your husband is important to you, you will be able to deal with the 'short term pain for the long term gain'. Being apart is no fun, especially during the first 2 or 3 years - but if that is the price that is needed to ensure a lifetime of happiness, then maybe you need to think about that as well.

I wish the best for you guys and hopefully you don't end up on welfare with me footing some of the bill.

Oh, come on. My father co-sponsored but didn't actually support us; we still managed to slide by on savings & my $9.00 an hour job at Wal-Mart. Personally, I think it's a LOT harder for old people to get by on a diminished income because they have more expectations as to what their standard of living should be. It's easier to be flexible (and survive on Ramen) when you're young.
