Question about DS-230 Part II

Okay, so one of the questions asks "Have you ever been refused admission to the United States at a port-of-entry?" and I have to answer "Yes."

Here's a bit of the background:

March this year I tried to go to the US with my fiance (Who was in a different part of the customs line at the time) and I was going to go stay there and get married and file paperwork. (Yes, I know that's illegal, I didn't know at the time).

Unfortunately, this got me put into secondary customs in which I got denied.

I have a copy of the "Application for Admission Withdrawl" which was also put onto my passport file, but it says nothing about how I got into secondary customs. I ended up landing myself in secondary customs by "not telling the truth" about my trip to the POE officer. Stupid, I know.

Now here's my question (if I'm asking for something against TOS, just tell me):

I have to write out why I got refused. Now, because my Application for Admission Withdrawl says nothing about me not telling the truth to the first POE customs officer, should I still admit to it in the explanation?

This has been on my mind for months now.

Any answer is greatly appreciated.

What did you not tell the truth about?

Regardless, they already know about your POE experience so stating that on your DS-230 is not going to affect your petition. However, NOT telling them might. You don't have to go into a HUGE discussion but simply state what happened. Say "denied entry on __/__ due to failure to qualify for visitors visa; told POE officer of immigrant intent" or whatever happened.

It doesn't need to be a huge dialogue of what happened, what the POE officer said, what the secondary inpsector said blah blah blah.

I was denied entry twice. I did not go into a huge account of what happened, just stated that I did not qualify for a visitor's visa because of lack of ties to Canada. Simple as that

PS - you are LUCKY they didn't slap you with a misrepresentation charge for 'not telling the truth'. That can land you a 3-5 year ban from the US.

Eh, I said I was just going down to the US for a few months to visit a friend, but then the POE officer saw my engagement ring... and ended up getting me to spit out the truth. Thinking back to that day makes me feel so stupid :lol:

I was going to explain all of that, but if they can just bring up the file on the computer, I guess I could just say that I was denied due to an immigration risk, I may just do that. And I may see a lawyer for an hour, since some lawyers give you a free 30 min to an hour.

I never planned on saying no on the paperwork, I don't need to get myself into more trouble.

And the official denial reason is "Subject was allowed to withdraw her application for admission and is inadmissable to the US under section 212(a)(7)(i)(I) of the INA."

Ok then all you need to say was that you were denied entry because of immigrant intent implied at the border (or if you actually said that you can say it was declared). It's not a serious issue, denials happen all the time (sometimes twice :) )
