Hi,

I have been reading up on entering the US and AOS, and I have come across the "I-94" several times. I hope this is not a stupid question... but is this something that we fill out or will my fiance receive this at JFK when he goes through Customs? Is it a stamp in his passport or a paper or a form? Will we need this to apply for a social security card? Thanks for the help! I didn't really know where to post this question but I'm sure someone will know. Oh one more thng, will they automatically give him temporary EAD or does he have to specifically ask for it? Thanks!!!

The I-94 is a long white card that is the Arrival Record and Departure Record which is handed out on the airplane before it arrives in the US. This needs to be filled out completely and correctly. The Arrival Record will be kept by the BCO and the Departure Record will be stappled inside the passport, with a stamp and an expiration date. It is very important to have this form, as it is required for AOS, SSN, and as proof of legal entry.

Sarah, I am sending you a copy of the I-94 in your email. It is a Dept of Homeland security, Arrival/ departure record. If I am not mistaken it is given to them on the plane. The form must be completed and presented to an USCIS personel at the POE.

Meriem_setif is right. On the flight to America you will be asked if you are a resident or a visitor. Depending on what you tell them you will get a form to fill out. That is your I-94. Fill it out before you get off the plane. At the POE they will ask for it. Don't loose it after you go through immigration!
