AOS for parents - what are the time frames to receive NOA?

Hi all,

Submitted my parents AOS (they are in US - B1/B2 Visa) - July 29th

Received by Chicago Lockbox (on July 30th)

No news since then....

They haven't encashed the checks nor have they sent any NOA ($1010,$355,$70 etc). It has already been 2 weeks since they received the I-485, I-130, I-864 etc...

Any ideas what might be happening? I do see a lot of other folks on this forum have received their NOA (difference being that they are all filing for their spouses?)

Any insight is appreciated

TimeLine:

7/29/2009: Parents AOS Application – I-130, I-485, I-131, I-765, G-325A submitted to Chicago Lockbox

7/30/2009: Package Received by USCIS – Chicago Lockbox

8/23/2009: 8 NOA Received for all submitted applications and checks

8/23/2009: 1 additional NOA received – rejecting the extra check sent (check returned)

8/27/2009: ASC Appointment Notice for Fingerprints (both)

9/17/2009: Fingerprints taken for both

9/21/2009: ASC Appointment Notice for Fingerprints (dad only)

10/2/2009: Advance Parole for both parents received

10/07/2009: EAD for both parents received

10/17/2009: Fingerprints taken (dad only)

10/23/2009: Request for Applicant to appear for Initial Interview (both parents – 2 separate letters)

10/26/2009: Police Letter requested for Dad

11/04/2009: Police Letter requested for Dad

11/30/2009: Interview completed

11/30/2009: Parents passports stamped with approval for GC

Hi all,

You are still within the normal proccessing timeframe for AOS, one thing that may have caused a hold up is the fact that you have sent too much money for AOS and I-130. The fee is I-485 with AP and EAD, $1010.00 I-130 $355.00 There is no fee for the I-864. so you may find that the whole packet will be returned to you to correct the error.

Hmmm - you have an interesting point about the excessive amount. The $70 checks that I had sent were meant for domestically reviewing the I-864 forms. Here is the quote from the Immigration forms link on the USCIS.gov site that I had referred to when sending the package

'I-864 - Although USCIS does not charge a fee for this form, the Department of State does charge a fee of $70 when the Affidavit of Support is reviewed domestically. This does not apply when the Affidavit of Support is filed abroad. '

Looks like my interpretation may have been off. Any ideas when this applies?

Well as you have filed the form with USCIS and not with NVC or an Embassy there is no fee to pay for the I-864. You only pay the $70 if you are filing for a immigrant visa and your spouse/relative is going to be interviewed outside the US, The NVC will review the I-864 and as this is done within the US and not at the Embassy/Consulate you have to pay the $70.

TatRivers is right, you don't pay $70 for I-864 if the AOS is sent to Chicago, I'm 90% sure this is the cause you haven't recieved your NOA's. Your package might be on its way back.

2-year green card application:

07/29/2009- Mailed I-130, I-485, I-693, I-864, I-864A, G-325A, I-765 via USPS.

08/02/2009- Package delivered to Chicago.

08/06/2009- Checks cashed.

08/10/2009- Received NOA's for I-485, I-130, I-765 (issued August 6th).

08/19/2009- Recieved Biometrics Appointment notice (bio apt 9/12 at 9am).

08/21/2009- Recieved RFE for I-485 (issued August 17th).

08/22/2009- Responded to RFE.

09/01/2009- Case processing resumed (RFE recieved on 8/27/2009).

09/01/2009- Walk-in biometrics at 1:00pm, in and out in 15mins.

09/09/2009- Recieved e-mail: EAD card production ordered on 09/08/2009.

09/14/2009- Recieved another e-mail: EAD card production ordered (AGAIN!) on 09/11/2009.

09/16/2009- EAD recieved in the mail.

09/21/2009- Applied for a SSN.

09/30/2009- Recieved SSC.

10/14/2009- Received interview notice (Interview on 11/16 at 9:35am)

11/16/2009- Interview,APPROVED and CARD production ordered e-mail!Yay!

11/19/2009- Welcome Notice Recieved and Card production ordered e-mail again!

11/27/2009- Received green card in the mail!

Removal of Conditions:

09/09/2011- Sent the package via Priority mail, with delivery confirmation.

09/12/2011- Package delivered.

09/13/2011- Check cashed.

09/14/2011- NOA issued and received on 09/17/2011.

09/15/2011- Biometrics appointment issued for 10/05

11/21/2011- Card production ordered.

- Once i receive the returned package, Is it a simple matter of me removing the cheques of the $70 and resending the same package back to them?
