Why are you going to a removal hearing and what kind of letter did you receive informing you of it? What did it say?

I'm going to a removal hearing because my AOS was denied. My ex husband was abusive pretty much through out our marriage and decided that he was not going to the interview. Due to the fact that the AOS was submitted 10 DAYS after the K1 expired and consequently AOS was denied it put me in to removal proceedings for violation of my status. If we had submitted the AOS prior to the expirary of the K1 and the and the interview was denied then I wouldn't have accumulated so much " out of status time " So whatever anyone says please make sure you submit the AOS before the K1 expires. My husband delayed this by not wanting to spend any moneyon the AOS. Nobody knows what's going to happen. At the time of submission I didn't realise our marriage would end up in divorce- nobody does!!!

In the meantime I filed an I360 for spousal divorce which set forth a prima facie determination in NOV 05. I got a letter in January 06 for a notice to appear. Last week I contacted my congressman and found out almost 6 months later that my petition for my I360 has basically been put on hold, until the judge authorises otherwise, that it can go ahead and be adjudicated. I was never told about this and kept wondering why it was taking so long to process.

So basically tomorrow. the judge has to decide whether to remove me or allow my I360 petition at Vermont to be adjudicated so that can I eventually AOS.

It has been a very hard process to deal with, especially not being able to work or get benefits. I have found the strength to carry only because I believe what I am doing is right. No woman or man should have to put with abuse.

The best of luck to you Shona, try not to let your nerves take over, stay strong!!! You put alot into your move here, emotionally as well as financially and as you say, you did not know it would end in divorce!! I never forget talking with you on the phone the night before your K1 interview in London and you were so very excited and happy about it and the fact that Jeff was going with you.

This is crazy, why are you being penalized when your @$$ ex-was the abuser.

Like you said, you could not read the future, if only we could see what lies ahead..

But, at the time, you took the leap of faith to come here and marry him, now you need strength to know what to do with your life next.

I guess either way will have advantages... Do you have family in England? Will you be able to work again?
