I have been reading many things about a waiver if you have filed for a K-1 or a I-130. I got married to a Russian lady in 2001 which I filed for the I-130 and she came to the usa. Things didn't work out so we divorce in Feb. 2008. She is a US citizen now and has been for about 3 years.

I filed for a K1 & K2 in 4-3-09, my question is, will I need this waiver everyone is talking about? I did put on my form that I did file a petition I-130 in 2001. Will this cause my case a delay?
