Hello everyone.. I'm a new member of this forum..

I came to US last November 2008 with B2/Tourist Visa. I applied for a F1 visa last March and it was approved. Now, I'm enrolled in one of the SEVIS schools.

Last Monday, August 10, 2009, my fiance and I went to Hall of Records to apply for the Marriage License and at the same time for the ceremony.

For the next step, we're planning to apply for the I-130 which is the petition for the alien relative and for the I-485/AOS. Can somebody help me what to do and what forms do i need?

I also have questions regarding the I-693 which is the Medical Exam Report and Vaccination. I dont have a record for my past vaccinations. Do i need to have all the shots again? :(

FAQ says this:-

Entering the US on another

type of visa, such as student (F-1) or H1B, followed quickly by marriage to a US citizen, and then followed

quickly by an application for adjustment of status might be construed by the USCIS to be visa fraud. The

reason for this is that you applied for the original visa, and then after entry into the US quickly applied for

adjustment of status, which makes the real purpose for your original visa request suspect. Bear in mind, the

onus to disprove an accusation of fraud from the USCIS is on the person petitioning for adjustment of

status. For this reason, I do not recommend applying for adjustment of status very quickly after you enter the

US on one of these other visa types (although filing immediately is still legal if you had no intent on marrying

and adjusting status both when you applied for your original visa and when you subsequently entered the US at the Port

of Entry). There is no time limitation on when you must apply for adjustment of status after marriage to a US

citizen...you could literally stay in the US for years before doing so, and as long as you maintained your status on the

original visa, it would still be fine. While applying for adjustment of status very quickly might lead to a fraud accusation

from the USCIS , the marriage itself is not an issue--no one will try to prosecute you in any way for marrying a US

citizen, even if it is not very long after you enter the US. The thing to remember is that you do not want to apply for

adjustment of status until a reasonable amount of time has passed after your entry. Shusterman recommends waiting

at least 60 days after entry before changing status. You may want to consult an attorney if you have further questions

regarding the timing issue for adjustment of status.

I totally agree with familyguy, everything is TIMING. If there is no time limit, there wouldn't be a Visa type like K-1. All boyfriends/girlfriends, fiancees would come to US on a let's say B1/B2 visa & then they would get married & file for AOS.

I want to add one more thing, your overstay after you get married to US Citizen will be forgiven by USCIS when you file for AOS.

Are you able to get someone from your home country to get you your vaccination record?

I was able to have my parents, after giving them written permission, get my medical records and have them faxed to the doctor down here.

It would suck to have to get every single shot all over again!

As said above any overstay will be forgiven once married to a US citizen :D

07/07/09 - NOA's Arrive for AP, AOS & EAD [dated 07/01/09]

07/17/09 - Biometrics Completed [ Completed in 17 Days ]

08/12/09 - EAD APPROVED! Card Ordered! [Approved in 47 Days]

08/20/09 - Interview notice arrived dated 08/18/09 - Sept 24th/09

08/21/09 - Got EAD Card in the mail!! :D

09/24/09 - Interview Date: 9:00am - APPROVED

10/03/09 -Received GC!!!!!

Total Days from NOA1 to Approval : 86 Days

ROC:

04/01/11 - Preparing for ROC currently

06/27/11 - ROC Mailed!

07/02/11 - NOA1 Arrived [dated 06/30/11]

07/13/11 - Biometrics letter arrived [08/01/11]

10/31/11 - Final Approval!

11/04/11 - Received new card today.

Total Days from NOA1 to Approval: 125 Days

Next Step will be citizenship in June 2012!

I called my mom but she told me that she cant find my record! it sucks! and i called the clinic explaining them my situation and guess what the guy told me "you should take all the shots again." wow...
