Has anyone filed for K1 twice?

Timeline

Is there any of you in such a situation? My fiance has applied before for a K1 visa but hasnt finished the process. We need to fill in now the case number and such info. You think USCIS will help us with this info?

Interview - 02/02/2010 - Visa approved!!!!

Entered USA (POE: Atlanta) - 02/15/2010

Marriage - 05/08/2010

You question is a bit confusing because a USC does not apply for a K-1 but petitions for an alien. It is the alien who ultimately applies for the visa... so it is important to know who is who

are you the USC or the alien fiance(e)

moving to IMBRA forum... this situation falls under that classification

Whoever applied before should have paperwork which will have the case number on it. Find the paperwork. I highly doubt anyone can call USCIS and ask what immigration or case number someone has. They wouldn't be giving out that information for sure. If there is no more paperwork, as in thrown away, or destroyed, you could just provide as much information on the form as you can, and they may perhaps do a search, given the information provided, in order to pull that file.

My mistake. I guess my English isnt that great. He petitioned for an alien fiancee before. I am the actual alien fiancee. He doesnt have the paperwork, of course. Otherwise I wouldnt be asking. So, how can he fill in the date? Thanks

If the earlier petition was more than two years ago, there is no reason for him to be concerned about a new filing. If it was less than two years ago, then he needs to write a brief letter requesting a waiver from IMBRA, and explaining why the earlier one did not proceed.

Thanks a lot for the answer. The earlier petition was more than 2 years ago. The only problem is that all the papers are at his ex and we cannot find her. So, we need the case number, date of filling... (question 11 in I-129F)

Any suggestions would be appreciated. Thanks

Due to privacy laws, you will not get that case number or anything else from the government. So, proceed without it. Luckily, there is no need to request a waiver under IMBRA.

Just explain that because of the situation and it's ultimate outcome no papers were kept by the US resident. He should provide as much detail in the explanation as possible.

yes I have done 2 k-1's but my exwife did get her citizenship in Feb of 2008

What you are talking about is not the big problem you may have. If your fiance is the us citizen and his ex is still in the us on a green card then the I-134 he filed for her is very much still in affect he is still responsable for her support until she works for 10 years or get citizenship or leaves the usa for longer than 6 months so her green card will not be valid any more or she dies. but with your case he had better be smart enough to scan or save in any way every document on your case.

Ohhh, Im so confused. I hope his previous relationship wont affect us.... He petitioned for K1, but she came in the USA with a tourist Visa so they decided to get married. I think they received their NOA1 in the meantime (not sure). So they didnt go through the whole K1 process. They were married for a year, then divorced. She married someone else last year and divorced again and i have no idea what her status is now, nore how we can get in touch with her.
