I was married to a filipina and we have now been divorced for 3 years this december. In Febuary 08 I went as far as the embassy with another lady. The embassy asked for more information and while finding this information I discovered I was making a terrible mistake. I cancelled the petition.

A year went by and I discovered that the girl I had been looking for all along was right under my nose (friends and nothing more up till that point). I filed for her and just received a letter called intent to deny. Long story short, having filed within 2 years of the last one I should have filed for a waver. I am looking for the waver form but cannot seem to find one. Any help would be appreciated.

There is no form. You needed to write a letter explaining the circumstances and formally requesting a waiver of the IMBRA provisions.

Improved USCIS Form G-325A (Biographic Information)

Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.

Let me get this straight though, this is going to be the third woman you have petitioned for?

I'm sorry if that offends your sensibilities but I will explain. I married philipina number one and now have a 6yo son whom I have custody of. After my son was born she came CLEAN one evening and admitted to being a lesbien. Now you can call me old fashioned but I always considered cheating is cheating even if it is with another woman. I also had to decide if I was going to allow my son to be raised in a home where the lines between men and women were confused. We are now divorced and get along just fine as friends.

Filipina #2 was a lovely girl from cebu and after we had gone as far as the Embassy and received a request for more information, I returned home and collected what had been asked for but when I went looking for her to give her what she needed to give to the Embassy I couldnt find her. I eventually did track her down, on the beech in Puerto Galera with a guy from the Netherlands. Once again it didnt matter how far I had gone through the process, cheating is cheating so I cancelled the process.

The woman I am currently with I have known for years butonly realized recently that the girl I have been looing for was right under my nose the whole time. Kinda disneyish I think.

You're calling Amykathleen rude? Your response was rude. They were asking if this was your third petition. This might impact on how they respond. You mentioned your first wife was a Filipina, however you didn't then, nor now indicate whether you petitioned for her also. Your waiver might well in fact be about two previous petitions not one. So I do believe it was asked for a specific reason. That being said, if this is now your third petition, you will need to write a letter (there is no waiver "form"), explaining the circumstances of both previous relationships. If you've only had one previous petition, then that is the only one you should refer to in your letter explaining how you cancelled that at the Embassy stage.

Amykathleen's question WAS pertinent to the question.

It sounds like you a bit touchy about the matter. And if you can't handle someone who is trying to help you asking questions about your relationships, good luck with the embassy.

These questions were asked because we all have read how difficult it can be to get through the Embassy in Manila. There is no waiver form, it's just a letter addressed to USCIS or the Embassy stating these other petitions, whether this is petition number two or twenty. These questions will be asked and you will have to make a good case that you know for a fact that this women is the one and is also not cheating on you. I trust that your relationship is solid and you have "investigated" her thoroughly and have been honest with her with all of this information. This WILL come up at the interview.

I would just like to say. What you are doing is good, and I am on your side. Some times people make mistakes in choosing the right woman I wish you luck on your 3rd try. I am on my second, and I know that the first try was a mistake and this time is the right time and the right woman.

I filed a waiver as it had not been 2 years since I filed the first time. The waiver is simple. I wish I had a copy of mine but it got sent to the embassy. It just is your name, and that you are requesting a waiver for the 2 year filing restrictions, tell them why you are requesting the waver and that is it. You probably do not really need to go into great detail that your ex fiancee was cheating on you when you went to give her the information, but you can just say that the relationship soured after you got the blue slip. You might even say that you feel she was using you just for the visa. Basically just put what you want in it with the reason that the other visa did not work out and you will be fine. Good luck!!

Just write what you wrote here, a little more diplomatically, and you should be fine for the waiver letter. Also make sure your current fiancee knows all about the past two relationships, as she may be asked about it at the interview.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Your request for waiver, a simple two-paragraph letter with your USCIS ID# on it, and signed, needs to get off to them right away by FedEx if possible. Attach a copy of the notice of intent to deny. No one has ever reported that a request for waiver has been denied--they just need to have it in their file. There is no need to refer to your ex-wife, as USCIS already has your divorce record, right? There is no reason to send it to Manila, as the USEM doesn't have any information on your new petition.

Of course, I am sure your fiance knows everything about the two previous women. I hope you aren't too paranoid about where she is hanging out for now. You need to trust her until she shows you a reason not to. That will be hard for you after what has happened to you.
