Do I have to file I-864 form same time as I-485

Hi All,

Background:

My wife is a USC and I am Canadian, we got married in Canada last aug '08, we now live together in the US. I am here on TN status which will expire in dec. 2011

I am are about to submit concurrently my I-130(spouse petition), I-485(aos), I-765 (ea) and I-131(ap).

I have a couple of questions;

1) do I have to file I-864 at the same time or can I wait, since it will take a few weeks to request the tax transcript

2) does anyone see a problem that I may encounter because I am applying for I130 a year after we got married and been staying in the US or it does not matter as long as my TN is still in good status?

If you call the IRS they will fax them to you.. Yes you need to file the I-864 with the rest of the paperwork. If you send without you will get an RFE and delay your case who knows how long. Better to file all together

Oldest son now 21 I-130 filed by LPR dad ( as per NVC CSPA is applying here )
I-130 approved 2/24
Priority date 12/6/2007
4/6/2010 letter from NVC arrives to son dated 3/4/2010
5/4/10 received AOS and DS3032 via email
9/22/10 Interview BOG Passed
10/3/10 POE JFK all went well
11/11/10 GC Received smile.png

Yes, I-864 is required to be sent with I-485. So does medical examination form I-693 and Biographic information G-325A.

2-year green card application:

07/29/2009- Mailed I-130, I-485, I-693, I-864, I-864A, G-325A, I-765 via USPS.

08/02/2009- Package delivered to Chicago.

08/06/2009- Checks cashed.

08/10/2009- Received NOA's for I-485, I-130, I-765 (issued August 6th).

08/19/2009- Recieved Biometrics Appointment notice (bio apt 9/12 at 9am).

08/21/2009- Recieved RFE for I-485 (issued August 17th).

08/22/2009- Responded to RFE.

09/01/2009- Case processing resumed (RFE recieved on 8/27/2009).

09/01/2009- Walk-in biometrics at 1:00pm, in and out in 15mins.

09/09/2009- Recieved e-mail: EAD card production ordered on 09/08/2009.

09/14/2009- Recieved another e-mail: EAD card production ordered (AGAIN!) on 09/11/2009.

09/16/2009- EAD recieved in the mail.

09/21/2009- Applied for a SSN.

09/30/2009- Recieved SSC.

10/14/2009- Received interview notice (Interview on 11/16 at 9:35am)

11/16/2009- Interview,APPROVED and CARD production ordered e-mail!Yay!

11/19/2009- Welcome Notice Recieved and Card production ordered e-mail again!

11/27/2009- Received green card in the mail!

Removal of Conditions:

09/09/2011- Sent the package via Priority mail, with delivery confirmation.

09/12/2011- Package delivered.

09/13/2011- Check cashed.

09/14/2011- NOA issued and received on 09/17/2011.

09/15/2011- Biometrics appointment issued for 10/05

11/21/2011- Card production ordered.
