Hi all,

This is a question for any Japanese nationals who have recently moved to the US to marry and are now working under permanent resident status. Do you have to pay Japanese income tax on your US earnings?

I am just curious if my fiancee will be double-taxed on her earnings in the US if she decides to work here.

Any information is appreciated!

Regards,

Deryck

Hi Deryck,

Japanese income tax is incurred when you have a domicile in Japan or have been residing in Japan for one year or more.

Once your fiancee loses her domicile, she is not subject to Japanese tax on her US income.

Just pay Japanese tax on Japanese income and US tax on US income for 2009.

Thanks for the info! That seems fair to me. I suspect that if the tables were reversed however, the US would still find a way to tax my Japanese income if I were living and working there... lol

My Japanese Ex never paid Japanese tax the whole time she has been a permanent resident here.

She does have the right to a reduced government pension should she return to Japan as she is still a citizen.

They have a system similar to social security but unlike social security you don't have to be a contributor.

This may portend a serious fiscal whammy for Japanese citizens down the road as their birth rate is not

keeping up with the number of retirees (the US population is expanding, but we are in no less deep sheeit).

The US is a real octopus. Not so for most other countries.

as my wife begins to understand the magnitude and scope of the US tax system she now understands this is not so much the "land of opportunity" that everyone thinks it is

I prefer to call it "the land of selective opportunity."

Sometimes good citizens are better off totally ignoring the best advice of their own government.

Many (not all) foreigners, on the other hand, are not encumbered by things such as patriotism

and "sense of fair play." It's still not suprising to see incredible success stories of people who

come here and quickly identify opportunities which to many US citizens are all but invisible.

It also comes from a different perspective, a fresh way of looking at things. Many things which

are allowed here are prohibited in foreign countries, so they are much quicker at spotting them.
