I am eligible to apply for citizenship on Dec 15th. Here is my problem. USCIS told me that they mailed my 10-year GC in Feb approval. But I never received it. Now they want me to file I-90 and pay the $370 fees. I don't want to pay the fees.

Currently I have 1 year stamp on passport that expires in March next year and have my conditions removed approval documents.

Since my passport stamp is valid till March and I have my 10-year approval documents, can I just file for my N-400 on Dec 15th and just ignore getting the 10-year GC?. I want to make sure that this is possible. Will there be any problems with this idea?.

Did you check with the USCIS or the post office if the 10-yr GC was returned to the USCIS? Maybe you can have it sent to you again.

By the way, just an fyi, you need a copy of the front and back sides of your 10-yr GC when you submit your N-400, it's in the N-400 filing instructions, page 5. http://www.uscis.gov/files/form/N-400ins.pdf

Also, it states further that:

"If you have lost your Form I-551, attach a copy of any other entry document or a photocopy of a receipt showing that you filed Form I-90, Application to Replace Permanent Resident Card."

And during the interview, the IO will ask to see the GC from you. So I'm not sure if just the I-551 stamp will be enough to satisfy the IO. Just a thought. I'm sure others with more knowledge or experience will chime in.
