I am new to this site (and forum). Apologies in advance if I my question does not appear to be well-researched through other similar threads here.

I will receive RFE on I-130 & I-485 (see the timeline below).

My questons are - What could the RFE be about when more than 5 weeks have gone by after the case was transferred to CSC? Only possibility is that I sent Consulate provided Birth Certificates for me and my mother. These were written by the consulate based on passports. I did not send any non-availability (consultate does not think it necessary) and affidavits from relatives.

Can anyone advise / share experiences?

Thanks in advance.

Wow you are just going to have to wait until you get the RFE try and relax until it comes, you will drive yourself crazy wondering what it is for. You shuld receive it in a couple of weeks and then Jump on it to get it back to them :)

Why is it that the only one who can stop the crying is the one who started it in the first place?

Couple of weeks?? CSC is supposed to be life in fast lane - speedy processing and all that !! Anyway, thanks for a prompt reply. Why I asked this question was that I have not seen too many cases where RFEs are issued for cases already in CSC and I thought it could be something major (BC related) or trivial.

No point driving yourself crazy trying to figure out what it is - best to wait until the RFE notice comes in the mail. Could be any number of things.

Thanks for a prompt response. See my reply to an earlier post.

It can definitely be since you did not submit the NABC(Non-Availability of Birth Certificate).

The I-485 or I-130 specifically states you need NABC and atleast TWO affidavits.

You may be right. I was proceding on the assumption that the BC provided by consulate is primary evidence - even the consulate feels that way - and no NABC + affidavits are required. I am surprised by the timing as my own BC / I-130 should have been caught much earlier in the cycle - that seems to be the trend in all cases before transfer to CSC.

Hate to tell you but what the consulate thinks is acceptable and what USCIS think is acceptable are two different things. You should follow the instruction that are given for people with NABC. You can get a RFE right up to and including at the interview. Hope you get your RFE soon and get your case back on track.

Thanks for your wishes. I only hope USCIS clearly spells out what they want and allows me a realistic time frame within which to respond with additional information.

second stage,

Assuming what you and I believe turns out to be true, do you think I should just get 2 affidavits to supplement the consulate-given BC which I sent OR get NABC + affidavits to replace the consulate-given BC.

While you await the RFE, go ahead and try to get the NABC + 2 affidavits.

I have seen several cases delayed as they did not submit NABC + 2 affidavits in cases where parents don't have birth certificates.

Thanks second stage,

In other words I should forget about the Consulate-given BC + affidavits scenario and focus on NABC + 2 affidavits.
