Hello there everyone. My husband just filed the I-129F after he received NOA1 a.k.a. I-797C for the I-130. Now we're just waiting for the NOA1 of I-129F which is I believe coming within this week. Please anyone can tell me what to prepare next while we wait for NOA2 both I-130 & I-129F? I've been reading forums but most of the time it makes me more confused on what to do next. I don't want to waste time you know while waiting for the NOAs to arrive, I don't know when but mostly 2-3 months right? I want to prepare everything so that we can mail the docs right away once we got NOA2. We are applying for K3 visa. I know that my husband has to prepare his affidavit of support etc. I read in USdept of state site ( http://travel.state.gov/visa/immigrants/ty....html#Immigrant ) that we need to prepare DS-156 & DS-156K. And also my friend told me that I need to prepare I-864 and also DS-157. So now I'm confused what do I really need from all this affidavit of support??? And in case our NOA2's will take longer than expected, where can i follow up? Is there a website than I can email them regarding our application? Sorry for too many questions. I can't sleep most of the time thinking on what to do, I want to be prepared ahead of time please help me & my husband. Thank you so much.

I would seriously consider pursuing the I-130 CR1 is they are approved at the same time. Only 3 or 4 weeks longer.

But, alot less headache after immigrating to the USA. (SSN Sent, Can work and Muli

Took us 134 days from I-130 submission till interview date. Ours was through CSC and really fast.

Get NSO Birt Cert, MSO Marriage Cert, NBI Clearance and any police clearance if you lived somewhere for more then

6 months.

Once, you get NSO#2,,, If pursueing the CR1. Download sign and mail to USC.... The DS3032 and DS230 (Part one Signed) with

all of the original Docs. If pursuing K3,, wait for packet from Embassy and proceed accordingly (Still need the NSO Stuff).

I am not clear about K1 vs K3

and what are IR1 and CR1

My query-is below can you pl advise

I am a Canadian Citizen, engaged to a US citizen (a US citizen by birth) .

We wish to get married ASAP to move to US.

I believe we can do that 3 ways:

1/ US citizen fiance can file a K1 Fiancee Visa I- 129 F and I wait out here in Canada till approved.

Maybe 5 months- I believe, is that correct?

My question is: Can I travel to the US while this K1 is being processed?

or 2/I can go to US on a visit- being a Canadian I can visit (is 6 months the staying limit-I am not sure) and then get married there and US citizen spouse files an I- 130. The processing time seems same at 5 months.

or 3/ My US citizen fiance comes to Canada and we get married

What form sare tehn needed to be submitted?

My question_Which option is safe- and can I travel-while case is being processed in each case

What is a better faster and safer option?

Main requirement is that I should be able to travel under these 3 options - between Canada and USA during this approval period

Please advise the best course, thanks very much

I am not clear about difference of K1 and K3 visa

K1 = Fiance Visa

K3 = Spousal Visa ( a lil faster than CR1 but you have to file for adustment of status when you arrive in the US)

CR1 = Spousal Visa 2 yrs conditional Green card (if married 2 yrs or less)

IR1 = 10 yr Green card (Married 2 yrs +)

If you are able to prove your ties to Canada (home, job etc) you won't have any problems travelling to the US while your Visa process is going through.

I travelled across the border every other weekend for 13 months while my papers were being processed and never faced any problems.

05-18-2009: K3 visa approved (Mumbai Consulate)

05-22-2009: POE LAX

*IR Visa*

07-10-2008: NOA1

03-05-2009: NOA2

08-15-2009: POE LAX

Hello and thank you for sharing your experience in this forum. Well let me shorten my story by telling you that im married to a US citizen and she filed the I-130 last week monday 10th Aug. i want to know, if approved can i apply for a non-immigrant visa or maybe you can tell us which way is proper....all i know is that how can we reunite in time. Kindly, help me with the necessary steps. And how long does yours take from the beginning to the end...
