Hi. My daughter and I have been in the US on CR1/CR2 visas. Our greencard expires April 7th 2011 and we will be filing for removing conditions way before that date. My question is, if my husband adopts my daughter before that time, do we still need to include her in the petition?

12-09-08 - INTERVIEW @ 6:30AM...God be with us! --- APPROVED!!!

12-11-08 - VISAS RECEIVED....YAHOOOOO!!!

04-07-09 - POE: Chicago O'hare

04-28-09 - received SSN's (after having to apply for them personally!!!!)

04-30-09 - Received our 2-year GREEN CARDS

01-07-09 - ROC, here we come!!!

01-18-11 - Mailed out I-751

Nope. I adopted my stepdaughter when she first got here. I got her a US passport proving her US citizenship after we had been married 2 years.

Since she was/is a US citizen there was no need for her to remove conditions.

Even tho it says to list ALL children in part 5 of the I-751 DON'T do so. It means to list ALL children that have to remove conditions.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!

Just to let you know you can only file for removal of condition 90 days before the exirpation date of you GC, not way before. Unless you get divorced then you will have to wait until 90 days before the date the card actually expires :)

As far as the adoption Haole has answered that for you :)
