Hmmm.. I thought you can only remove that once your AOS is approved..

According to the Internal Revenue Service, the 400 richest American households earned a total of $US138 billion, up from $US105 billion a year earlier. That's an average of $US345 million each, on which they paid a tax rate of just 16.6 per cent.

You can not get it removed from your SS card until after you receive your GC.

What it means is, that in order to work, you must have a valid Temporary EAD received at your POE (like JFK), or a valid EAD card. Then you can work.

A K1 is "work authorized" incident to status.. and is "eligible" for proof of that authorization, which means they are permitted to apply for an EAD... but an EAD is not the only "proof" that exists.. particularly various visa can have different proofs.

I believe wording on the SS Card is meant to say that you must have "proof of work authorization" ...

----------

The K1 visa itself (incident to status) is authorized to work.

Acceptance as proof of the employment authorization includes the I-94, whether it is stamped or not.

The SSN memo says, "The I-94 is proof a K1 alien is authorized to work".

RM 00203.500 Employment Authorization for Nonimmigrants

https://s044a90.ssa.gov/apps10/poms.nsf/lnx/0100203500

1. Aliens Work Authorized Without Specific DHS Authorization

The following lists nonimmigrants, by alien classification, who are authorized to work in the U.S. without specific authorization from INS. The alien's I-94 will not have the INS employment authorization stamp and the alien will not have an EAD.

----

The problem is getting employers to believe this since the I-9 which guides them is not necessarily up to date with SS memos ... even the USCIS websites will contradict info between the three players here...

So, the EAD appears the easier common denominator to all three as proof without argument... therefore, just get the EAD...

You know, my social security card still says that, it was issued in 1993 when I first came to the US. I was 12 then and couldn't work anyway, so I never bothered changing it, even after I became a USC. I've never had any problems before.

Yes you can, because even if you remove the wording (eventually when you get your GC) your SSN will be the same. What's important for the DMV is that you actually have a SSN.

The Social Security Administration (SSA) does not delete, destroy, rescind, inactivate or cancel Social Security numbers once they are assigned.

The SSN card having the legend, “VALID FOR WORK ONLY WITH DHS AUTHORIZATION,” only means the number holder cannot use the SSN card as proof of work authorization. It does not otherwise affect the validity of the card or number.

SSA has agreements with most states to verify the SSN, date of birth and name information provided by individuals applying for driver's licenses.

Once you have proof of permanant resident status, i.e. I-551 stamp or card you can apply for an unrestricted SSN card.

So if K1 is authorized to work in the U.S. without specific authorization from INS then SSA does not need to put ""VALID FOR WORK ONLY WITH DHS AUTHORIZATION" on the SS card.. right?

This would not be an adviseable path for SS... A K1 expires in 90 days and the SS has no way of knowing if a K1 will follow the expectations of getting married or will skip town with this new authorized work card.

There is still the burden of "proof" of work authorized.. so SS has put that burden on the visa holder to have something from DHS.. the I-94 or EAD is often cited as proof for various visa holders (prior to a GC).

Got it. So you can work for 90days w/ just an I-94 as a proof of work authorization (if not applying for EAD) until you get your GC. Thanks zixuandavid
