Hi all, the following 2 were not mentioned in the Mega income tax thread going on in the forum.

Out of curiosity:

1. Does anyone know if the foreign spouse has to report foreign income on the STATE taxes

2. Does the exclusion 2555 EZ work everywhere and anywhere, or only for certain countries?

not enough info to answer as there are 50 versions of state tax law....

Not accurate. There is no individual state income tax in AK, FL, NV, SD, TX, WA & WY.

Not accurate. There is no individual state income tax in AK, FL, NV, SD, TX, WA & WY.

Please read more carefully my answer... where did I use of the word "income"?

Just a guess because I'm not looking it up, but if you were a citizen of another country, lived there and earned money from a local employer, I don't think it would matter where it was. The point is you didn't live or earn money in the US or get paid by a US firm during that time.

I don't have a clue about how state income tax works. We don't have it.

Just to throw a monkey wrench in the whole issue:

General Information

"If you are a U.S. citizen or a U.S. resident alien living in a foreign country, you are subject to the same U.S. income tax laws..."

Techinically, a K-1 finance who moves here, gets married, and is now together filing jointly is NOT a U.S. Resident Alien living in a foreign country anymore....she is just a U.S. Resident Alien living here now.....

So I believe no, she doesnt have to report income from her native country form earlier that year..
