hello there,

wondering if anyone can guide me in the correct direction. ive tried to follw guidelines on here but its pretty confusing.

i am english and i travelled to meet my girlfriend in New Jersey at the end of May. We have now ended up getting married (yesterday) and we are now wondering what procedure to follow and how much it could cost. sorry to be a pain, if this aggravates anyone but we'd really like some help in what to do next.

I know that i may have to leave after the I-(4 expires...or before, so to speak. But I would really like to stay together with my new wife if at all possible.

Any help would be fantastic

Since you are already in the US and I assume did not intend to come to the US on a tourist visa with the intention of permanently immigrating, you may file the I-130, G-325 and the I-485 to adjust your status from tourist to resident. You will also, if desired, file for the AP (required to travel outside the US) and the EAS (required for working).

If you didn't intend to immigrate, and have a fair amount of proof, you can file while here in the US to adjust status.

If it's going to look to the USCIS that you came here with the intent to marry and stay, you need to go back to the UK and have your spouse file an I-130 petition for you.

Thank you so much for your advice. It was intended as just as holiday and to enjoy the chance of being together. Financially it is somewhat tight and we are looking at ways to go about filinf these forms. do we have to file within 90 days exactly or just as soon as possible? are the fees payable all in one foul swoop or in seperate parts.

File as soon as you can, make sure you don't overstay (ie stay beyond your I-94 given to you). There is a large chunk that is to be paid at the beginning (The I-130 and I-485) but other fees will follow.
