EAD with RFE for AOS

Hello,

I would like to ask if it is possible to have an EAD even if I have RFE for AOS? I was wondering why one of my friends ofc mate said she started working after 8 months but got her green card earlier than her working permit. Is that possible?

I believe, if you have an RFE for AOS, before your EAD is approved, then the EAD and AP get put on hold as well as AOS, now I maybe wrong but as far as it looks, everyone who's had a RFE before EAD, the EAD seemed to take a little longer to get approved. As for getting the Green Card before the EAD, the green card is all you need to work, the EAD is a temporary work permit until you get your Green card. So if you get your Green card before your EAD, your good to work and really don't need the EAD. I believe they do the EAD so that way they can take as long as they like with approving the green card, because in most states you can do everything with just your EAD.

An RFE on your AOS will result in processing being suspended on the EAD until the RFE is resolved - it is certainly possible that you would already have your EAD issued before they even get to your AOS/I-485.

yeah, I`ve heard people were getting their GCs before their EADs. I don`t know how to explain that... government. But usually, when you get an RFE it suspends your I-485 too. We lost about 2 weeks due to an RFE. But it turned out ok in the end.
