AOS application

hi all i got a question.. been in US for 6 months now through K1/K2.. got married and got ssn.. but we havent apply for adjustment of status yet.. just wondering is there any expiration or just a span of time for applying AOS? till when then? any answer will be much appreciated. tyvm

Your currently out of status. You are acquiring "out of status" days that will count against you (180+ triggers 3 year ban if you leave the US and attempt to re-enter).

You are subject to issues with ICE.

With all that said, you should file for AOS ASAP.

You are supposed to apply by the time your I-94 expired. Many people don't from what I hear but you are Out OF Status...

A K-1 visa gives you permission to enter the US and get married within 90 days. It doesn't give you permission to remain in the US. To do that you need to file the AOS. Once the I-94 from the K-1 expired you became out of status and are accumulating out of status days. Acquire 180 out of status days and if you need to leave the US you will incur a 3 year ban on re-entry even if you have an AP (Advance Parole). Accumulate a year of out of status days and the ban increases to 10 years. As long as you are out of status you are vulnerable to deportation as mentioned above. File for your AOS asap. That is your permission to remain in the US.
