1, We filed for AOS Oct 2008. His medical had been done in July 2008 for his visa.

2. We received EAD and AP in January.

3. Filed AR 11 change of address in May 2009 and received written confirmation they had updated the address.

4. RFE mailed July 15, 2009, did not receive it.

5. Made service request after 15 days for new copy of RFE

Today we finally received his RFE for a new medical exam, his expired while his AOS was pending. Along with the RFE was the old envelope where it had been mailed to the old address. Amazing we received the second one they sent out since the mailing label was so smeared I could barely read it. That's big KUDOS to the USPS for deciphering the address label rather than returning it to sender.

So....

1. He is way outside the processing times for his AOS, almost 10 months since filed

2. They never updated our address although we received written confirmation they had received it in May.

3. I remember reading somewhere that a new medical would not have to be done if it had expired while AOS was pending.

4. Only given 18 days to submit the new medical (due by August 26)

So we did all the right things, have waited a long time, and USCIS is doing nothing. Typical government red tape.

We will do a new medical next week, send it certified, return receipt mail, along with a copy of the memo about the medical not being needed to be redone due to expiring while AOS is pending, a copy of the receipt for change of address dated May, and a copy of the memo regarding the need for the background checks to not be finished prior to issuing a green card.

Sorry had to vent. He is waiting and waiting and because our government is so screwed up he is still waiting.

Did the RFE specifically say we have your medical but it has expired? Or did it just say we do not have medical information. The difference being, they may have never received the brown envelope you turned in at POE. It happens sometimes that the files don't meet up. It's still an annoyance, but not that they changed the rules about the validity of a medical if AOS processing drags on. But you're stuck paying the bill for another medical either way. Frustrating!

after carefully reading the letter, the medical exam was rejected because it was not done on the new form. His exam was done july 2008 and was submitted on the old form. Good enough for his visa but not good enough for AOS.

I am just amazed it took nine months for them to realize this.

Just a comment - I had one of those incredibly smeared labels as well - it was on my 2nd AP when I received it several years ago. I too give kudos to USPS for delivering it - the postman went above and beyond the call of duty to decipher the mess and figure out where the envelope belonged. Looks like they still haven't corrected the labelling address machine. I often wonder when we hear about mail being returned as undeliverable and someone not getting something important if the real issue isn't them having a bad address or USPS not delivering it, rather it is that the label is so smeared while it is being printed by USCIS that it is illegible. I did send them back a letter with a photocopy of the smeared address label at the time advising them that they had a problem - never heard anything back.
