Hello everybody,

This is my first post ever, please excuse if I am not clear on things.

I need to file I-864 for my spouse for IR-1, but my income for 2008 is less then poverty line (Around $8000.00 short). I only worked 6 months in 2008 and stayed 6 months with my wife. My income in this year is good enough and above poverty line.

I have enough assets to cover the difference ($8000*5).

My sister living in same house, her income is above poverty line (above enough to cover all 3 of us) but we file seperate Tax Returns.

Please tell me if it is better to use my Assets or Family member income.

Which one gets approved easily. I dont want to delay things with NYC.

08-30-2009: I-130 Sent

09-22-2009: I-130 Approved

10-02-2009: NVC Received

10-05-2009: Received DS-3032/ I-864

10-06-2009: Return DS-3032

10-16-2009: Receive IV Bill

10-16-2009: Pay IV Bill

10-19-2009: Sent DS-230

11-02-2009: Login Failed

11-03-2009: RFE (Missing PPC, Now need it at interview)

11-05-2009: Case Complete

12-10-2009: Interview, VISA APPROVED

If you can prove your current income is above the poverty level, in addition to the tax transcripts of 2008, and you include assets, you should be good to go doing it yourself.

(btw - it's 3x for spouses)

But your current income should be sufficient. I would also include 2006/2007 to show you have a history of steady income

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
