Hi everyone,

I have a couple of questions. Im American, my husband is Dutch, he got his green card in Nov 2008, it is a 2 year conditional resident status. I have a couple of questions:

1) We moved ( just a few blocks away :)) back in February and my husband did not fill out an AR-11. He is going to do it now, obviously not within the 10 days required. We he be penalized or will they just let it go?

2) He was laid off from his first two jobs in the US and after much searching and our the situation with our economy he has been unsuccessful finding a job in his field. He wants to return to the Netherlands for a year to work. We would still get back in time to change his status the 90 days before.

I read that he can leave for up to a year without filing any paperwork, but it also states that his permanent residence status "MAY" be in jepordy if he works in another country. Is this true? What does "May" mean? Anyone have any thoughts or suggestions. Should he apply for reentry before leaving. Will it look bad for immigration if he spends one of those first two years living and working in another country?

3) Also, we are currently in the Netherlands for six weeks visiting family and friends and he has taken part-time work with an old employer, is that going to jepordize his status as well?

Any answers, suggestions,etc would be extremely helpful.

Hi,

1) they will most likely let it go.

2) it means it will be up to the POE officer to let him in or not. He could apply for an advance parole to make it safe.

3) not a problem.

CR-1 Timeline

March'07 NOA1 date, case transferred to CSC

June'07 NOA2 per USCIS website!

Waiver I-751 timeline

July'09 Check cashed.

Jan'10 10 year GC received.
