Going for E3 work visa

I've been offered a job that relates to my Communications degree in the city where my fiance resides.

As I am an Australian citizen, I am eligible for the E3 work visa which is similar to the H1B and alot easier to obtain.

My question is this:

When I apply for the visa, will the consulate view unfavourably that my fiance lives in the same city? I'm worried that the visa will be denied based on this fact.

Has anybody been in a similar position?

02-05-2011 - EAD card & AP paperwork received in mail
03-31-2011 - 2yr Conditional Green Card Approved
12-01-2011 - Moved out after dealing with repeated infidelity and unfaithfulness
06-13-2012 - Divorce finalized
03-04-2013 - I751 packet (removal of conditions) mailed to CSC

Isn't the petition initiated by the employer?

Unlike the H1B visa, the employer does not need to put in a petition for alien worker. All that is required is a job offer letter and a completed LCA (Labor Condition Application).

My worry is that the CO will see that I've previously visited that city to see my girlfriend (now fiance) where the job is being offered.

Would there be grounds to deny the visa based on the fact that my fiance resides in the city where the job is?

Timeline

Yes there would be grounds to deny your work visa if the CO thinks you are using a work visa to get around immigration law. However, it will be up to what you say and what the CO determines your intentions to be when you petition for the visa.

I think if your job is legit and you truly qualify for the position then it should be OK, but no one knows for sure until you petition for the E visa.

Timeline

The two hurdles are the CO and CBP official. If they believe that you have immigrant intent and are using the E3 rather than a K or CR1 you could be denied or turned back at the POE.

Certainly worth filing for the E3.
