Hi all,

Although our case hasn't finished at the CSC, and I have no idea when he will have a second interview, I was wondering if anyone knows if there is an expiration to the I-864? I will be going to Morocco again next month and I would rather take this stuff with me than mail it. I signed the first one on 4/15/05, so it is now over a year old.

Should I simply take a copy of my 2005 tax return or do I need an entirely new I-864?

I looked at your timeline and saw that it is placed on 221(g). Now did they Embassy or USCIS ask for any new I-864 from you? If not, you don't need a new I-864. 221(g) is administrative processing. The Embassy will call you as soon as the processing is done. I hope, it happens very soon for you.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Thanks for your response. They haven't requested anything yet, it is still at the CSC. I am one of those planner people that has to have every detail in order...lol

I figured that simply taking in my latest return would be sufficient.

My understanding of the I-864 [at least the old form] is that it has to be submitted to the government within 6 months of it being signed and notarized.

I would say prepare a new I-864 with the most recent documentation including 2005 tax return. If not needed, then all you have wasted is time spent preparing it while waiting already. If they do request a new one and one isnt prepared, this is going to cost you even more time. I agree with Mary K in that the old form has an expiry, just not sure how that relates with the new rulings, nor when one is in AP, so better to be on the safe side.
