Hello,

I wanted to know for proof of income form, does it matter if my husband sent in his taxes for 2008 or can he send in an earlier year. If so how what is the cut off year. For example would he be able to send in his taxes from 2007 or even 2006 or since we are filing this year he has the send in the most recent tax return. I hope that wasn't confusing .

Another question I had was, I wanted to know is that my husband has been unemployed for about 6 months would we need a co-sponsor bc of this?

You have to file with the "recent" tax year (of the year filing) - so for 2009, you would have to show 2008 taxes.

You can show 2006/2007 if you think it will help show your case - but you will need the 2008 year.

Yes - if he doesn't have current income now, he will need either assets or a sponsor to cover the affidavit.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
