When was your K1 issued/when does it expire?

When do you need to be out of the U.S.?

You need a plan that is actually doable.

Rereading your original post and deciphering the typos, it appears to me that you want to bring your son for a couple of weeks using the K1 and then return with him to take him home.

You will not be able to do that.

Would it be possible for your new husband to return your son home while you remain in the U.S.?

well not only do i want to have my son here for a couple of weeks without him using his visa K2 (he has been issued bc the 1st decision was on my side) but i want to be back in france to care to make another request to the judge (assembling proves and all and work with the lawyer and be not so far from my child. One their (JUDGES) silly reasons were that i was not married *rolls eyes*

so in fact, we planned to get married in september, but we are going to make it soon, and i a; just up to cross the canadian line.

ok, i thought the advance of parole coudl be made but you have to pay.

anyway thanks for all of you and your answers.

Before you go, you might make an info pass appointment to see what your options are. Maybe if you are UNmarried, you can ask for your visa to be reaffirmed at the embassy or something similar, so be sure you have explored all your options before taking steps.

I'm surprised that there is still a question about your son, usually they don't issue the K2 unless they are sure that you can take him permanently out of the country. How frustrating!!!! :(

June 4, 2009: Interview - APPROVED!!!

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

well, first of all, it didn't work, so we got married on the 14th of august so that i can make the AOS and I have asked an expedite request zith a letter explaining why and attached the evidences.

second, about why they issued the visa is bc on 22nd of June, i have been granted the right to live in USA with Julien...so on the 9th of July he has been issued his visa...

but my ex made the appeal late in July.

i hope i am making things clearer.

but now, i am wondering how we can track our adjustment of status.

have you any idea?

I just went through the instructions for AP (I-131) and to my dismay, didn't see the K-1 mentioned (It did mention K-3).

She is very concerned about wanting to be at her son's university graduation (July 10, 2010).

That wording about "extraordinary measure used sparingly" gives some concern because naturally it's not a matter of life or death.

As the K-1 visa is valid for one entry for 6 months, she could be there if she waited until July to exercise the visa.

That's not an appealing prospect. :bonk::dead:

Anyone have experience with the K-1 and advance parole?

I got my answer to that part:

If form I-485 Application to Register Permanent Residence or Adjust status

was filed and is pending that is a pre-qualification for a request for AP.

(it's on the form in plain sight)

When we apply for AP it will be concurrent with the AOS application.

I'd just like to hear the good (and bad) of other people who applied for and used AP.
