Hello everyone,

I am struggling with the papers. and my family situation.

i need feed back from people here. So admitting I am married. The next day i can do the necessary to be issued the social security number right?

and then how long does it take to have it?

second question, then i can apply for the advance of parole.

what the requirements to have it?

how much does it cost?

how long it takes to have it issued?

are we limited in the number of travels and lenght of the journey abroad?

why all those questions, simply bc i have a child and the judge allowed me to bri like a couple of weeks.

If you plan to get your social security number with your married name, you will need to take a certified marriage certificate with you and there needs to be more than 14 days remaining before your I-94 expires. Can you have the marriage certificate by the next day in your state?

You can apply for Advance Parole (I-131) at the same time as you file for adjustment of status (I-485). There is no additional fee for the Advance Parole or EAD -- they are benefits included when you pay the $1010 fee for adjustment of status.

The Advance Parole will take around 60 days to get and there is not a limit on how many times you use it.

You can try - most people do it prior to being married, then change the name - check the guides above for more info.

and then how long does it take to have it?

Depends, week or two.

second question, then i can apply for the advance of parole.

When you file for the AOS, yes. (make sure you have no "out of status" days more than 180+)

what the requirements to have it?

Spelled out on the form, but if you file for the AOS, that meets the criteria and will not cost anything to file.

how much does it cost?

No cost, if filed in conjuction with the AOS.

how long it takes to have it issued?

90 days. If it's an emergency, you can go to USCIS/INFOPASS and ask for one.

are we limited in the number of travels and lenght of the journey abroad?

It is only good for one year. Multiple use.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

i see a bit clearer, and i forgot to precise that my ex made the appeal and won it.

so we are figuring out solutions

ok, so anyone can tell me about the info pass. how we make that?

in i need to go back to France on the 1st of September.

and can i stay there one month?

what do they call family unity reasons?

If they grant you an AP - no issues going for 1 month.

If you try to get the AP prior to filing for the AOS, you will have to pay a fee. $305.00

Ginger, according to your timeline, you haven't left France yet...Do you think that it might be a good idea to just put off coming to the US until you have this sorted? You have another 5 months to use your visa yet, so there's not technically a rush.

Trying to get here, get married, get AOS filed, get "emergency" AP and fly back in less than a month just seems needlessly stressful if you haven't come over yet. This is why they give you 6 months to use the visa, so you can tie up your loose ends before you come over.

You can apply for the SSn the day after arriving, you do not have to be married. Apply in your name as in your passport. My wife applied 16 hours after arriving and had her SSN the next business day and her card in 6 days.

You can apply for an AP immediately when arriving, fill out the form and drop in the mailbox at the airport with the $340 fee, but if you get married first and send the AP application with your AOS there is no additional fee. They have 90 days to issue an AP, usually a little less. The AP is valid for one year, for multiple entries. If your stay outside the US will be more than 6 months you should get an AP for that specific trip, other wise the "open ended" AP is valid for multiple trips

I'm missing something.

The instructions for AP include the following:

B. If you are in the United States and seek advance parole:

1. You may apply if you have an adjustment of status application pending and you seek to travel abroad for emergent personal or bona fide business reasons;or

2. You may apply if you are classified as a refugee or asylee and you seek to travel abroad for emergent personal or bona fide business reasons, or you are traveling to Canada to apply for a U.S. immigrant visa. (See Part 2, Refugee Travel Document onPage of 2 of these instructions, for additional information on refugee/asylee travel); or

3. You may apply if you have been granted Temporary Protected Status or another immigration status that allows you to return to that status after a brief,casual and innocent absence (as defined in 8 CFR244.1) from the United States.

Why would the OP be eligible immediately on arrival?

Actually, I'm confused about the OPs status in general. What does this mean:

the thing is that I am at my fiance's, in the us. I came without using the visa K1 for i explained about the fact i was waitint the appeal and if the judgement was the same, then I needed to pick up ;y son in france on the 23rd> and i was co;ing to get prepared everythin for the year school and his room.

and bad news>>i have to change everything. amd io can't see ;yself living in the usa wihtout my child.

so i need to have that advance of parole and be able to travel to be with ;y son th e;ost i can meanwhile we made another request to the judge.

then for the AP, i file for it today...

i have heard they can deliver it in the day? is that possible?

i guess i am going to care for the SSN right away...like today.

ok, as i entered the us under the waiver visa> do you know if i can just crossed the frontier in canada and be back> i mean, by car.

there are some POE this way? or it's only via the airport?

You are not currently in a status that allows you to apply for AP. You will be wasting the filing fee.
