Timeline

Okay, so after we get married and have my fiance´s status adjusted, within 6 months we are planning on returning to Peru so she can finish a year and a half of school that she has left. Is that plausable? Would it be possible if we returned every few months or something like that? What could the possible consequences be?

Applied for K-1 visa - Feb 26, 2009

Recieved K-1 Visa - Aug 6, 2009

Married - Oct 23, 2009

Applied for AOS, i-485, i-765, & i-131 - Dec 6, 2009

i-765 & i-131 approved - Feb 1, 2010

I - 485 approved - Pending

Year and a half? - the AP is only good for one year - so you would have to do something at the one year mark (get it extended)

I would imagine in that time, you would probably get your interview and other appointments for the AOS for the GC, so I would not think it would be wise to do that (timing issue).

I would suggest, perhaps, to wait till you get the GC - then you can get permission to leave for 2 years - which will cover the amount of time your looking at doing.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
