yes my husband came to USA on a K1 visa and we were married here in USA, all papers, documents they asked for were given, i think the interviewer didnt like the fact i am older then my husband, we compared questions and there were only 3 different answers, we have to wait now until they decide to send the denial in writing, they said it can take up to 60 days, we have contacted an immigration lawyer, i dont see how someone who dont know us can say we r committing fraud

How big age difference.

AND...what 3 questions could they have tripped you up with...list them please.

So maybe this should be moved to the AOS forum since it really isnt MENA related. The OP will probably get much more useful info there from ppl who may have experienced this situation.

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

my husband and i had filed all our papers and until the final interview everything was fine, all papers were filed in time and completed, at our final interview the interviewer decided without a proper interview that we were in a fraud marriage, she asked only a few questions off the forms we had submitted, her supervisor did another interview and asked me and my husband different question and then said our answers didn't match, now we have to wait up to 60 to get a letter as to why we were denied, we r not in a fraud marriage ,, what do we do now?? any suggestions will help

essaouira, was the interview for adjustment of status than? I did not see anything on your timeline to understand, but I hope you can turn this around. (F)

I absolutely agree 100%!! He is already here on a K1, so this is adjustment of status. The returned petition/application process as dicumented is useless for AOS denial. This should be moved back to the AOS forum. I would also suggest hiring an immigration attorney very familiar with cases who have been denied at the AOS stage to assist you.

So if my understanding is correct, your fiance came here on a k1, you gus got married, you applied for AOS and were denied. Possible bc if age difference. I really cant imagine bringing my fiance here and getting married and then his AOS gets denied. We also have a age diff, I am 41 and he is 23. But I look like im about 35 and he looks close to 30.... I would go crazy if they denied him and I can only imagine how you must feel. May I ask what your age difference is? But that should not be the reason. They approved him to come here in the first place 'knowing' the age difference, so what was the deal breaker now I wonder. They cant deny you for reason of age.

RFE only matters when you are lacking of any document or If the office needs something from you, When it comes to the decision, they don't give you RFE before giving their final words like Approved or Rejected.

Please provide more information if possible. We are talking about a K1 visa out of Casablanca but you are referring to your husband? Are you legally married or just engaged to be married?

Casa is a notoriously difficult post due to a large amount of visa fraud, many applicants are refused due to circumstances which are viewed by the consular officer as a red flag.

First off, a denial such as this at the consulate is not a hard denial...they cannot deny the visa petition, they can only refuse to issue a visa for the application and return the petition/application back to the original local service center for review along with their recommendation for revocation and the reason(s) why.

When a visa application is refused at the time of interview by a consular officer, the Department of State (consulate) is required by law to notify the beneficiary of the intent in writing. So, your husband/fiance should have been issued a Department of State document with details of the outcome such as 221g - ...and the reasons for visa refusal. Some receive this 221g with comments that say "pending administrative processing" So it is important for you to know exactly what this paper says.

It is important for you to act quickly, have him scan this document and send it to you via email ASAP. Depending on what this paper says will determine your next steps if any are available to you.

Send me a PM when you get that paper, and let me know the wording. I will then be in a better position to point you in the appropriate direction for more information on what you can do.

If you could provide everyone with info on the specifics that some members have asked for we could give you a much better idea on the pontential reason for the denial and please update your timeline.
