Hi everyone.

I'm new to this site, and still trying to read lots of the posts. I'm Canadian, still living in Canada, and my husband is American, living in the US. (married May/04 in Canada). We have been doing the commute to see each other for 5 years (dated over 3 years, and then married), We only live about 1.5 hrs from each other. We have finally decided to send off the paperwork. He is in the military and been deployed alot for the last couple of years, so we decided that I would stay here with family/friends/good job for a while, instead of moving to a new place with him being gone all the time. To start, he will be sending off the I-130 and G-325A's, and then once we receive a receipt for that one, we can send off the K-3 visa app (I-129F)? We will be sending it off in the next couple of weeks to start the process. Are we on the right track so far??

Nov 20/2007: Applied for SSN because it wasn't done for me... UGH!!!

Dec 03/2007: Received SSN in mail... YAHOO!

Apr 11/2008: GC finally arrived

sounds good to me. I suggest you read the guides and as many questions related to the same visa that you are going for. look at forms ahead of time and just be ready for things before they come up. good luck.

23rd February 2005 Married.

10th May 2005 I130 packet sent to TEXAS forwarded to Cali.

12th May 2005 NOA1 Received date.

14th May 2005 delivered at 4:34 am LAGUNA NIGUEL, CA 92607.

23rd May 2005 NOA1 notice date.

27th May 2005 NOA1 hits the mailbox.

13th August 2005 po po form mailed off with £10 cheque.

2nd September 2005 po po letter arrives.

3rd September a 4 week visit to GA assuming i get allowed in.

30th september 130 days on I130 and counting.

(Hopefully i finally get a wedding ring today too)

30th November NOA2 date. woohoo

January 2006 case arrives at NVC finally(not sure about exact date)

17th February 2006 IV bill mailed back

21st April case complete (sorry i have missed some dates of forms going back and forth)

2nd May case forwarded to Embassy in London

10th July 2006 visa interview 10.30 a.m.

It sounds like you have it all figured out. I don't think you half to wait for an approval to send the I129f. I could be wrong. In my husbands case the I 130 (Cr1) was approved faster.

Since you are already married you dont need to apply for the K-3. I would suggest sending off the I-130. K3 is for a fiance visa, and since you are already married you dont need to.

Since you are already married you dont need to apply for the K-3. I would suggest sending off the I-130. K3 is for a fiance visa, and since you are already married you dont need to.

Incorrect. A K-3 is a spousal visa. The I-129F is used for both the K-1 fiance and the K-3 spousal visa. If one wishes to hedge their bets with the CR-1 and K-3 spousal visa.....then one sends off the I-130 and when one gets the NOA1 they then send off the I-129F petition which is for the K-3.

June 25, 2004 - Bruce & I met through mutual friends in my hometown in Newfoundland the night before he was going back to Maine

July 1 - First email between us

July 3 - I called him to wish him a Happy Independance Day

Daily phone calls and emails from there on in

October 20 - Bruce drove back to Newfoundland. He planned on staying a week but it ended up being 3 weeks. We knew for a fact we were in love!

March 19/05 - Bruce back in Newfoundland

April 8 - Bruce picked me up in North Sydney, NS and we drove to Maine. I stayed for a week due to work

July 26 - Bruce back to Newfoundland for another 3 weeks. I can't bear to see him leave.

August 10 - He asked me to marry him.........I had already asked him anyway just to make sure*_*

September 30 - I flew to Boston to meet Bruce there and then we drove back to Maine for 2 weeks

The I-130 is definitely the first step. The K-3 is an option but not required. Is your husband currently home in the US or is he deployed? The reason I ask is that the timeframe for K-3 seems to be that you only save a few weeks time, though that can certainly change at any moment. If you aren't in a hurry to move, save the money and just go through the process of IR-1. If you come in on K-3 you either have to adjust status or go back to Canada to complete your interview anyway.

My husband will be deploying in a few months, but will be back by December. That was another one of my worries with him going away, regarding the address we will be using, which would be his. But he won't be there to get anything they may send him.
