still need more info to decide which visa, please advise

Hey guys, first of all thank you for everyond who answered our previous questions.

but we have another thought. we are thinking to apply for tour visa, and get married in the United States as soon as I get there, then file either CR-1 or K3 in the States.

we'd like to know if anyone knows if this way is faster or file K1 faster.

If we file CR-1 or K3, should I return to China wait for or can I wait in the States. If I have to return to China, how long will I wait to get the visa?

Thank you guys.

p.s. I just think this whole visa thing is a joke, rediculous, we should be able to be with our loved ones wherever and whenever, shouldn't have these much barriers we have to deal with. Isn't it human beings' basic right? Life is already hard enough to live and be alive, now just add another stupid matter to fight for.

What you are considering is against the rules. It could potentially result in a life time ban. Entering the U.S. with INTENT to get married and then adjust status is illegal.

Immigration to the US is a priveledge not a right. Be careful becasue what you are trying to do with the tourist visa is illegal and can result in a life time ban as mentioned. If you can even get the tourist visa as these are not easy to come by either. Go for the CR1 visa 9-12 months baring and AP or other problems, come in the right way and live a happy life. Good luck.

By coming here and geting married and then back to China it will be as mentioned 9-12 months baring any complications

A few things.

  1. As daboyz stated, coming to the U.S. with a tourist visa with the intent to marry is illegal. Illegal things are bad, m'kay. Going that route would be incredibly shortsighted.
  2. I know it's hard to wait, but that's the way it is.
  3. It is a basic human right, I suppose, to be with whoever you choose. It is not, however, a right for you to bring your foreign wife or husband to the U.S. That is a privilege. You have the option of moving to China and living there with your SO, don't forget. I know it's a rough process, but there has to be some process in place.
  4. You'll think a lot differently about this once your SO is here in the U.S. with you (i.e. after the visa is granted). I speak from personal experience.

If she came as part of a "tour", she might visit but the tour company holds the passport and posts a bond to guarantee all tour members return together.

True, but in the outside chance she pulled it off, he should know the consequences of entering on a tourist visa with intent to stay.

THank you very much guys, no one trying to do anything illegal, we are all lawful citizens and humans, we are going in and going out of all the coutries we've been by the books. Just ensure that we will not make any mistakes, since we saw people posting here that they get married in the states while the fiancee was on B1/B2 and students visa, after get married they return to their home countries to wait for the visa.

well, we will live in China, expecially in current economy, as we all know. because of the business is in the States, so still need to live in the States.

We love both coutries, to be able to live in both China and the States are ideal, isn't it.

Really appreciate your inputs.

I'm not sure if it is difficult to get married in China, but one thing you should look into is DCF (Direct Consular Filing.) This will require you to be married and in most (if not all) countries you have to prove at least six months residence in the foreign country. This path is extremely fast and will result in a CR-1 visa. (2 year green card)

well, living in China is just another an option for us right now, otherwise we would just live in China for good enjoy the quality life there.

we will file K1.

I'm from a very successful family in the States, both education background and financially very strong, and my fiancee is employeed in one of the best company in China as sales account manager position. will this help with the process speed at all?

I'm asking this question is because one of her girlfriend from Taiwan got married with an American, neither of them were in good financial condition, (low income) and her k3 was denied for 3 times, her visa was finally approved by the 4th time.

Well, only to the extent that compared to somebody who tries to immigrate without a qualified sponsor, you'll avoid that issue. In general, the standard for satisfying the public charge concerns is 125% of the poverty level and no meaningful extra consideration is given for greatly exceeding the requirement. It COULD work against you in considering the bona fides of your relationship but not in and of itself.
