Just engaged to a Brazilian - Can she study here?

Hi everyone,

I just got engaged to my Brazilian girlfriend and I'm new to this forum, looking for answers.

We are debating getting married here via a K1 fiance visa, or getting married in Brazil via a K3.

My question is if the following is possible:

My fiance wants to take an English course at a university here in the US from January-March 2010. She will either need a student visa, or we will get married in Brazil and October and try to bring her here in January as my wife. Is this possible in the 3 month period? Or, is it legal for her to travel to the US as a student WHILE she is waiting for the K3 visa?

Unlikely that if you marry in Brazil in October that she will be with you on an immigrant visa in January.

You can apply for a student visa for her, however she will have to prove that she intends to return to Brazil since a student visa is non-immigrant. This will be difficult for you to do since you are engaged and will be married in a few months.

My advice, marry and file the Cr-1 and this will allow her to study when she arrives here as your wife. Or file the K-1 now.

A student visa will not be granted unless she is accepted at a university and plans to study for a degree, not just take a course in English. She needs to be a fulltime student.

She can take that course in Brazil.

Definitely not as easy as you thought. To get a student visa, she first needs to contact an accredited university to grant her admission. The process can take a year. And it has to be a full time course and not just a certificate course. Once she's granted admission by the school, they will issue her a paperwork that she can present to U.S. Embassy to apply for the student visa. That's another process and she needs to show proof of domicile in Brazil, intent to come back after her school and ultimately show some dough to the government that will indicate she can support herself while being a student in US.

K3 is not quick either. K3 people on VJ have been waiting for a long time to be reunited with their spouses.

If you really want to be with her. My advice is file for K1 visa, it is more faster than anything! It will only take like 6 months to process. Or else you can marry in Brazil and file for the K-3/I-130. And then if she'll arrive here in US and be a permanent resident that's the time she can enroll and go back to school if she wants to.

Applying for student visa in US takes a lot of preparations and some schools needs a lot of requirements.. especially the SEVIS and USCIS.

Hello, in case if she want only go your Country study,is the student visa.

But if she want stay in USA it you,have one situation.

That happen to me,my husband is american.

Us marriage in Brazil, but i try get visa the tourist because i want live in Brazil.

The embassy deny my visa, they say is because my husband no have job there and no have nothing for he want stay in Brazil.

After 9 mouths the marriage,i learn in all places you can imaginate,i call too.

And only one information work for me.(one secret information)

The informstion the embassy there ,say if you want marriage in USA, need aplly for fiance visa,but if you are married in Brazil you apply in embassy the Rio de Janeiro and need make alot the procedments,she need make examination with doctors alot stuf and money for spend.

That is all embassy says that, but is lie , i do no why they do that, they dont care with feelings the people and do tratment the ###### with us brazilian,but after 9 months one person work in embassy say me the true,if you read marriage and try get visa in not much time the marriage, they go deny because think is fake marriage.

But if pass some months,in my case 9 months and my husband apply for permanent visa in my Country,that way he work and hva condition for stay in my country.

Happen is the dad my husband get sick in USA and my husband want back live there,well one person there the embassy in Sao Paulo tell me one secret, if i enter legaly in USA in my case tourist visa you can apply for greencard in USA, no need back for Brazil for do that alot the stufs they say need.

And is better because you no go be apart,if you apply from Brazil you canot stay so long only if you apply for permanent visa, that case the both go be apart for time can be 6 or 9 months,somes rares cases is a little less.

I did what that person tell me,and work good is true,but before i trip i take my paper the marriage and translator with one tralnslator public for english and go the embasy USA for they give value my marriage,if i no do that only the marriage have value in my country (Brazil)

I sufer much with that wrongs and lies de embassy in Brazil,all times they no say the true and after 9 mouths only one tell me what i need do.

For apply permanent visa in Brazil is easy,but you need translater your bourn certicate and need take in USA only your blackground because the embassy there no do that.

And for my husband get that blackground he need back for USA without me,and us far for 3 months!!!because no one can take that.

I suffer much,i just in that period are marriage in one mouth and need be apart.
