What does Fiance need to bring from his country for AOS?

hi my lovely VisaJourney it´s been a while since I´ve been here but here I am with lots of questions for you knowledgable folks, once again!

So we´re getting ready to enter the US with my fiance´s approved K-1 visa! and we were wondering...

1. what documents does my fiance need to bring with him from his country in order to complete the AOS process? from what I´ve gathered he needs a birth certificate (original), the x-ray from his medical exam and of course the sealed package in order to get into the U.S. Anything else?

2. Then there´s the selective service. My fiance is 25 but will be 26 on oct. 19. would it be better to wait until after his b-day to file for AOS so that he doesn´t get on the ss list? or would they put him on and then take him off again once he turns 26?

3. Finally, there´s much talk of the 1-94 form...entrance and leaving... do they give him this form at the POE point of entry? or how does he obtain this form? because he´ll need it for the AOS but I don´t understand how he gets it in the first place.

Ok that´s all for now I really appreciate any thoughts or ideas that you have!

If he enters the US before he turns 26, he will have to register, regardless if you delay the AOS. You don't get "taken off" the list, they could still call you up even after you turn 26+

3. Finally, there´s much talk of the 1-94 form...entrance and leaving... do they give him this form at the POE point of entry? or how does he obtain this form? because he´ll need it for the AOS but I don´t understand how he gets it in the first place.

Get it on the way in - the airline usually gives it to you before deplaning in the US.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

If he enters the US before he turns 26, he will have to register, regardless if you delay the AOS. You don't get "taken off" the list, they could still call you up even after you turn 26+

If your fiance's birth certificate is not in english, get a certified translation. I didn't bring that and had trouble finding a translator. Other than that, I think your questions were answered.

2. Bummer with the selective service....

3. the 1-94: the airline just gives it to you? should we ask for it, will they KNOW to give it to us, and if so, how? because looking on USCIS website there´s a form I-102 that costs like $300 just to the the 1-94 form! I don´t get it, so why would they give it to us for free on the plane? we don´t need to apply for it, for sure?

4. and a new one: VACCINATIONS! so as a K1 holder my fiance will NOT need to get another medical exam, correct? But he DOES need a vaccine supplement. How does that work? Is that something he can get in the US with a US docter looking at his vaccine cards from his country? Or must he get some kind of official document or form signed by a docter here in Ecuador his country? One person posted that "he needs his DS 3025 vaccination records from his medical". Would that be part of the medical exam paperwork that is probably included in our sealed package or is it a separate form we need to have a docter here fill out, if so, how does one find it? (i couldn´t find it on USCIS website)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

USCIS will handle his registration with the Selective Service System on his behalf if he's still of the right age when the AOS is approved. That's how my registration was eventually done (just 4 weeks before my 26th birthday :lol:)

Somebody once posted here while I was trying to work this out (I was in a similar-ish circumstance) that the SSS consider anyone who enters with intent to remain to be resident, regardless of immigration status and that a male K-1 between 18 and 25 should register themselves as a matter of course. However, I tried to register myself prior to completion of AOS and was rejected, twice (once online, once on mailed submission).

If he's likely to turn 26 before the AOS is completed, you need to make a judgement call about whether to register him yourselves or not. It's not like there's ever going to be a draft, this is the 21st century after all. The SSS is a relic of WWII, nothing more so you might as well try and register just to make sure your butt is covered when naturalization time comes around. Maybe you'll be more successful than I was :unsure:.

Really, it's yet another example of where K-1's fall through a procedural crack by being non-immigrants who enter with no intent to leave...

"Normally" he should have been given the DS 3025 by whoever gave him the medical.

He doesn't have to have a complete medical when he gets to the US if his immigration wasn't more than a year when he applies for AOS.

LOTS of designated civil surgeons will try and hit him up for a complete medical. Go with DR Arnold in Texas.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

The SSS is a relic of WWII, nothing more so you might as well try and register just to make sure your butt is covered when naturalization time comes around. Maybe you'll be more successful than I was :unsure:.

The Selective Service System is not a draft to be sure, but it can be used for a general call up (draft) if needed.

With the current war fronts going on now, and the retention rates in the US Military, if something major blows up, they may have to resort to the draft to fill the ranks...

The current version was enacted in 1980 btw (Jimmy Carter)

1. Bring an origianl of every persoanl document he can lay his hands on. He is moving here for life, no sense in keeping personal documents 486,000 million miles away. They need to be in your desk drawer at his home in USA. If he does this he will have all he needs for the AOS and more.

2. What? He is not required to file for SS until he is an LPR, no possibility of that before October 19.

WOW!!!!!!! My cousin was "relic-ed" in 1967 and the VC dropped a mortar shell in his lap (probably a relic also, but it still worked as advertised, just like the SSS) . Wish he was here...

You do not need to register until approved for AOS and if you are past 26 at that time, not a problem.

They should know to give it to you, but on rare occasions someone posts here that they did not receive one. According to my husband who is the one who did they flying, they hand them out on the plane to everyone who isn't a USC or LPR. Just make sure you get it. :) The I102 is an application for a replacement should you lose yours.

You do not need to register until approved for AOS and if you are past 26 at that time, not a problem.

I'd be inclined to agree with that interpretation myself but my advice was more about backside covering than anything else. If you're living in the country for some time before you become an LPR and towards the end of that timespan, you turn 26, it might be wise to register (if you can*) such that there cannot possibly be any problem or confusion should the LPR file N-400 down the road.

Clearly if you read what the SSS say and then look at what USCIS actually do, the two are at odds with each other when it comes to if/when K-1's should register so IMO, a 'better safe than sorry' approach is the way to go.

*The cited reason they wouldn't let me register before my AOS was completed was not that I wasn't eligible/required but that that my SSN couldn't be verified, whatever they mean by that.

Perhaps the meaning of what I wrote didn't come across. I described the system - the conscription of soldiers from the general population - as a "relic" because it's not really relevant to the modern age. Nobody, including myself, doubts the contributions and sacrifices made by those who were drafted during the Vietnam War. That's not what I was saying, as I suspect you know...
