Hi Rahul,

Thank you. I have received mail from CRIS saying " Request for initial evidence sent, case placed on hold".

But I have no idea what is this for besides the NABC. What do you think and how did you get your email when you received RFE?

Yeah I got the same e-mail and was wondering what is the RFE about and then when I finally received the yellow paged RFE I came to know its about the Birth Certificate. They also send you the Indian 1969 law page about Registering Birth and Death. You would have to wait till you get the letter to see what it is about? But I would still say start getting NABC.

i guess it is nothing to do with me but can you tell me what is this Indian 1969 law says? i am curious becuase of my parents and ofcourse they are 1952 born so. if you can?

By the way, i read somewhere is that USCIS will give us a tracking number so that we can track at their website about our status when they "touched" or when we can get EAD..or may be i am wrong because I did not see any case number/tracking number at the NOA today at all...

Indian Birth and Death Act of 1969 law says that everybody born after April 1, 1970 should be registered. So if you are born after 1970 you should have a Birth Certificate, if not you must get a NABC. Since your parents are 1952 born you need only affidavits and school record for proof of Birth. I would assume your RFE is not about Birth Certificate of your parents. I am attaching Indian1969 for your reference.

Now You must have a receipt no . That receipt no is your case no. You can create an account on uscis web-site https://egov.uscis.gov/cris/jsps/index.jsp and add all your cases on your portfolio. Then you can keep checking them :blink: Obsessively like me (everyday) or at your own sweet time :thumbs: . You can also have them email you when they do something with your case.

Now You must have a receipt no . That receipt no is your case no. You can create an account on uscis web-site https://egov.uscis.gov/cris/jsps/index.jsp and add all your cases on your portfolio. Then you can keep checking them :blink: Obsessively like me (everyday) or at your own sweet time :thumbs: . You can also have them email you when they do something with your case.

Indian Birth and Death Act of 1969 law says that everybody born after April 1, 1970 should be registered. Received RFE today. It says that I need to sumbit I-864 Affidavit of Support & I-693 Medical Examination.

My questions are:

1] We already submitted this with the AOS application, but the problem maybe is that it is not updated b/c my husband and his joint sponsor filled it up last year. Back then, he was only working for $8.50/hr. But now, he is working for $12.50/hr but only contractual until Dec.'09. In the IRS transcript, his income on 2008 is $11k+, 2007 is $4k+, 2006 is $14k+. Does he need a joint sponsor?

2] In I-864, how much will I write on Part6 #23, if he's currently working for $12.50/hr?

3] In I-864, #25, what will I write on the Total Income? Is it the one in the IRS transcript that says Income Wages, Salaries, Tips, ETC?

4] I already had a medical examination last 2007. Do I still need to retake it? or do I just need to get my medical records?

Kinda confuse and nervous right now because of this RFE letter, and I hate computations :innocent: Thanks for your help, I really appreciate it.

Hey Chiqy, I'm a bit confused by your questions, but will try to lelp:

1) Yes, your husband needs a joint sponsor. For 2 people in the household, his income hs to meet the poverty guideline of $18,212, for 3 people it is $22,887. The form has to have a current date,so you have to submit the form with the current (2009) year's financial information.Hence, the annual household income is what your husband earns in 2009.

2) Get your husband's paystubs for the whole 2009 year, and add up the amounts of each paystub up till today (gross amount-pretax deductions). Then estimate how much he is going to earn by the end of the year: If his paychecks' amounts are always the same, just calclulate how many paychecks he will recieve till the end of the year and multiply the number of paychecks by the amount of money per paucheck .If he is working a set amount of hours, hence gets the same pay every paycheck, that shouldn't be hard to calculate.

3) This line is used to sum up the income of all household members. So, if your husband has a joint sponsor, and it's another person living in your household, then he adds his income to the household memeber's income. If not, you just transfer number from line 24a to line 24c. You take "adjusted gross income" from his tax-return.

4) Medical Examination is valid for ONE year, so if you had it in 2007, and it's 2009 right now, you definitely have to retake it, sorry.

Sorry you recieved RFE, hope you figure it out fast!

P.S. If you are using a joint sponsor, he needs to fill out another I-864. If it's a household member, he fills out I-864A. Each has to include last year's tax return, paystubs for the last 6 months and/or employer letter. It seems to me you need a co- sponsor with a stable job who is able to provide an employer letter, since your husband's job is not permanent and a co-sponsor with a stable job would make up for that.

Ok, what I have is I-864 of my husband and the joint sponsor ( joint sponsor is where we live at right now, he's my husband's brother-in-law)

Does the joint sponsor need to fill out I-864A rather than the I-864?

So, the joint sponsor is already married and filed joint taxes with his wife. How will I deduct his own earnings to add up to my husband's earnings?

Also, I have my husband's paychecks for the last 6 months, what does the joint sponsor needs to have other than his&his wife's tax transcripts?
